Acer Laptop Memory Class Action Settlement

AcerAcer has reached a class action lawsuit settlement over allegations it sold laptops that did not contain enough memory to properly run the pre-installed Microsoft Windows Vista  Premium operating systems. Eligible Class Members who submit a valid claim can receive a cash award of between $10 and $100 or a free Flash Drive from the Acer class action settlement.


The Acer memory settlement will resolve a class action lawsuit (Wolph v. Acer America Corp.) that claims certain Acer Notebooks contain 1 GB or less of RAM to be shared between the operating systems and the graphics, which is less than Microsoft’s requirements that a computer have more than 1 GM of RAM in order to properly run the Vista Premium OS. The plaintiffs claim that as a result of this insufficient system memory, Acer’s Notebooks suffered from freezing, crashes, lock-ups and other poor performance.

Acer denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the Acer class action settlement include all U.S. residents who bought a new Acer Notebook that came pre-installed with a Microsoft Windows Vista Home Premium, Business and/or Ultimate operating system, which contained 1 GB of RAM or less as shared memory for both the system and graphics, and have not returned the Notebook for a refund.

The Acer Notebooks covered under the class action lawsuit settlement include some, but not all, of the computers with the following model numbers:

As a Class Member, you’re entitled to receive one of the following benefits from the Acer computer class action settlement (each Class Member can only get one benefit):

  • A 16 GB USB Flash Drive with ReadyBoost technology;
  • A check for $10;
  • A check for up to $100 as reimbursement for Class Members who, before April 25, 2013, paid for Notebook performance repairs in an effort to resolve performance problems due to RAM; or
  • A compatible 1 GB or 2 GB laptop memory DIMM for Class Members who still own their Notebook that will allow the computer to operate with 2 GB of RAM.


The only way to receive one of these benefits is to submit a valid Claim Form postmarked no later than July 24, 2013.

A Final Fairness Hearing is scheduled for October 4, 2013. Benefits will not be paid until the settlement becomes effective and all objections are resolved.

    i love my acer lap-top. however, i did have some memory problems but, i have managed to use my computer to its fullest. thank you. ps, could use a flash drive.
