AndroGel lawsuitA Tennessee consumer has filed a testosterone product lawsuit against AndroGel manufacturer AbbVie Inc. after he allegedly suffered a stroke after using the testosterone gel.

Plaintiff Larry Burk, 67, was prescribed AndroGel by his physician to manage a low testosterone (Low-t) condition. Burk used AndroGel as directed from Aug. 3, 2012, until around February 2014, his testosterone product lawsuit says.

On Dec. 8, 2012, Burk suffered an ischemic stroke for which he required weeks of hospitalization and in home therapy to manage his condition. Burk alleges that his stroke directly resulted from his use of AndroGel.

According to the AndroGel lawsuit, “Defendants knowingly, purposely and deliberately failed to adequately warn Plaintiff, patients, consumers, medical providers and the public of the increased risk of serious injury associated with using AndroGel, including but not limited to death, cardiovascular events, stroke, and thrombotic events.”

Burk and his physician claim that had they known of the dangers associated with the use of AbbVie’s testosterone gel, a different medication would have been prescribed.

As a result of his injuries allegedly caused by AndroGel, Burk alleges strict liability, negligence, failure to warn, breach of express warranty, breach of implied warranty, misrepresentation, concealment, negligent misrepresentation, fraud, and violation of Unfair and Deceptive Trade Practices Law against AbbVie Inc.

The AndroGel Testosterone Product Lawsuit is Burk v. AbbVie Inc., et al., Case No. 1:14-cv-06682, in the U.S. District Court for the Northern District of Illinois.

Testosterone Product Side Effects

Testosterone products like AndroGel are aggressively marketed toward middle age men who are experiencing low testosterone conditions as a natural result of aging, and are losing muscle mass and experiencing a decreased sex drive as a result. AbbVie Inc. and other testosterone product companies market their testosterone gels, shots, and creams as a prescription solution to a low-t condition and allegedly promise increased sex-drive and vitality.

However, Androgel, Axiron, and other testosterone products have some serious risks and side effects.

Some serious testosterone product side effects include:

  • Blood clot
  • Enlarged prostrate
  • Heart attack
  • Stroke
  • Death

In general, testosterone product lawsuits are filed individually by each plaintiff and are not class actions.
