Hydroxatone settlementA proposed class action lawsuit settlement has been reached between the companies behind the skin care product Hydroxatone and customers who claim they were duped into purchasing the products based on a “Risk Free Trial” offer that the companies didn’t honor. Consumers who purchased Hydroxatone-branded products between 2005 and 2013 may be eligible to receive a cash award or free product if the class action settlement is approved.

The Hydroxatone settlement will resolve a class action lawsuit (Susan Sabol, et al. v. Hydroxatone LLC, et al.) alleging, among other things, that defendants Hydroxatone LLC and Atlantic Coast Media Group LLC:

  •  failed to adequately disclose the terms of their “Risk Free Trials” and “Auto-Shipment Programs;”
  •  refused to refund customers who timely returned Hydroxatone products;
  •  failed to allow consumers to timely cancel Hydroxatone Preferred-Customer BeauyAuto-Shipment Program memberships’ and failed to cease billing consumers for Hydroxatone products after they cancelled their memberships.


Defendants deny the allegations but have agreed to resolve the litigation by establishing a $3 million class action lawsuit settlement fund to refund eligible consumers, as well as provide up to $4 million in free Hydroxatone products.

Class Members of the Hydroxatone class action settlement include all U.S. residents who between January 1, 2005 and March 28, 2013 paid for, and/or were charged for Hydroxatone-branded products, and/or were charged shipping and processing fees in connection with a Risk-Free Trial and/or Auto-Shipment Program.

These Hydroxatone-branded products include, but are not limited to: Hydroxatone, Celtrixa, Hydrolyze, Declatone, Lashatone, Instant Effect, Luminique, Instant Wrinkle Filler, and Orexis.

Class Members are divided into two groups:

Group One

You are a Member of this Group if you are a Settlement Class Member who (i) tried to, attempted to, made efforts to, or took any actions designed to return Risk-Free Trial product(s) and/or Auto-Shipment Program product(s) and paid more than shipping and processing and/or return postage in connection with such product and/or received additional shipments of product for which you paid, OR (ii) cancelled and/or attempted to cancel your Auto-Shipment Program memberships but received additional shipments of product for which you paid more than shipping and processing and/or return postage.

If you are a member of Group One, you will be eligible to receive your choice of either a pro rata share of the Net Settlement Fund (the “Cash Benefit”) or a “Product Benefit.”

A “Cash Benefit” for Group One Settlement Class Members will be made to Approved Claimants in the following amounts:

  •  A Claimant who spent more than $200 with Defendants after all prior refunds will be eligible to receive (subject to a pro rata reduction) $100.
  •  A Claimant who spent between $100 and $200 with Defendants after all prior refunds will be eligible to receive (subject to a pro rata reduction) $75.
  •  A Claimant who spent less than $100 with Defendants after all prior refunds will be eligible to receive (subject to a pro rata reduction) $40.


The Cash Benefit will be subject to a pro rata reduction if the total Approved Claims exceed the Net Settlement Fund. In the event that all Claims are paid for by the Net Settlement Fund, without any pro rata reduction, no funds will revert to Defendants.


A “Product Benefit” for Group One Settlement Class Members will be made to Approved Claimants in the following manner:

A Claimant who spent more than $150 with Defendants after all prior refunds will receive their choice of one of the following products:

  •  Luminique Facial Brightener 3 oz. (Retail Price $49.95)
  •  Sunsoak Age-Defying Self Tanner 1 oz. (Retail Price $59.95)
  •  Pore Minimizer Serum 1 oz. (Retail Price $59.95)
  •  Instant Wrinkle Filler 30 Day Boxes (Retail Price $59.95)
  •  Instant Effect 30 Day Boxes (Retail Price $59.95)
  •  Celtrixa Stretchmark Lotion- Original Formula (Retail Price $59.95)


A Claimant who spent $150 or less with Defendants after all prior refunds will receive their choice of one of the following products:

  •  Hydroxatone Anti-aging Body Lotion by Celtrixa (Retail Price $19.95)
  •  Declatone Deluxe Sample for Retail 0.5 oz (Retail Price $29.95)
  •  Hydroxatone Gentle Milky Cleanser 3 oz. (Retail Price $39.95)
  •  Hydroxatone Age Defying Toner 3 oz. (Retail Price $39.95)
  •  Keracalm (Retail Price $39.95)


If you choose the Product Benefit, shipping and processing charges will be paid for you from the Cash Fund and you will pay nothing for the products which you request (so long as there is a sufficient amount in the Cash Fund; otherwise this will be subject to pro rata reduction). Defendants reserve the right to substitute products based upon supply.

Group Two

You are a Member of this Group if you are a Settlement Class Member, but are not a member of Group One.

If you are a member of Group Two, you will be eligible to receive a Product Benefit, which will be your choice of one of the following products:

  •  Hydroxatone Anti-aging Body Lotion by Celtrixa (Retail Price $19.95)
  •  Declatone Deluxe Sample for Retail 0.5 oz. (Retail Price $29.95)
  •  Hydroxatone Gentle Milky Cleanser 3 oz. (Retail Price $39.95)
  •  Hydroxatone Age Defying Toner 3 oz. (Retail Price $39.95)
  •  Keracalm (Retail Price $39.95)


If you choose the Product Benefit, shipping and processing charges will be paid for you from the Cash Fund and you will pay nothing for the products which you request (so long as there is sufficient amounts in the Cash Fund; otherwise this will be subject to a pro rata reduction). Defendants reserve the right to substitute products based upon supply.

The deadline to submit a claim for the Hydroxatone class action settlement is August 15, 2013.

Eligible claims will be paid only if and when the settlement becomes effective. A hearing is set for July 16, 2013 to determine whether or not to approve the class action lawsuit settlement.

    When I realized they wanted my card number for payment of an actual product, rather than for shipment cost for a sample I was irate! I tried to end the call, but they still had my number. I quickly called back and explained to the voicemail what happened, I was hoping they would fix the problem. Yea, right! They got 3 payments out of me before it stopped, and that was only because I finally just cancelled my card. I sent it back, but still got no refund. What a nightmare!

    I returned product after using about half because it burned my eyes and made my skin red. They gave me such a hard time with outrageous waiting times and moving me around from dept. to dept. They sent out an invoice for the one I returned and shipped me another. I never got paid for the shipping or the second shipment. Only problem is we cannot find paperwork. Can I still get involved and you find evidence at the other end?

    I tried Hydroxatone & I was allergic to it. I returned the rest of the unused product I DID NOT receive a refund and they kept billing me. After several attempts to resolve the issue, after being billed and they kept taking it out of my checking account. I NEVER received any kind of refund, nor was I offered another kind of product. I had to pay $25 to put a stop payment, this was the only way to resolve it. They kept calling me numerous times a day to try to collect the money. They said they were turning it over to a collection agency.

    I received monthly shipments which was more product than I was actually using so at one point, I wrote and asked that they stop shipments until they received further notice. After a short while, they resumed shipments which I did not authorize. I paid for one or two, I can’t remember, and after that, I wrote “Return to Sender” on the box and refused to receive any more. I also felt that the trial offer was very deceptive. The size of the containers were not what I expected, from the ads. I felt that the the company handling Customer Relations to be very impersonal and uncaring considering the price of the product. Unfortunately for me, I liked the products but I will not order more from them for the reasons stated. I would rather do without.

I tried several different times(hey I paid a lot for this), but each time the same thing. They sent me more products, which was taken from my credit card. I called, called, loved the office hours. I got some money back, and finally got the product stopped, when I returned last package that came in the mail.

    I spent MONTHS trying to resolve this. These are crooks and deserve jailtime!!! I went to the postoffice to return 2 empty jars of hydroxatone. (As they required) When I got no refund, I called them. They said that just because I sent the jars doesn’t mean they got them!!!!!!What more proof do they need than the slip from the post office???? I wrote to every agency I could think of!I expect $59.00 from this.!! No one could pay me for the time I spent. They had different phone numbers every time I called?!!!     I was a victim of this scam, I order this product from a radio ad. I told the lady on the other end of phone that i only want to do the one time free try order and just pay for shipment and handling. Neatly to say the orders kept coming and they continue to draft money from my account. After calling several times to have the draft stop which didn’t happen I to had to final just cancel my credit card. I don’t know exactly how much was draft from my account, but it was taking out of my account and I do want my money back, because like the other victims say the product does not work. Please get me a refund!

    This product was advertised falsely as a free trial. You had to send back the unused portion if you were not satisfied. That does not give you a chance to try it for a month. Also.. I had to close my bank account just to get them off my back. I sent everything back to them. I even called the radio station and spoke to advertising that they were promoting a bogies product. I am so glad this is being brought to light. I learned my lesion. Never falling for this kind of thing again. Nothing is new under the sun. Good old fashion Oil of olay. and eat well.

    Its about time something happened to this false advertising company!! not only is the company terrible for putting this deceptive product out but the people in the call center are just as deceptive as the product!! I ordered the product within a few weeks cancelled my order and returned the rest of the product, well within the same week it was returned to me, when i called the 800 number, one of the so-called managers told me he was reversing the charges on my credit card that by the way they were STILL CHarging!!! when in actuallity he was trying to charge my card again RIGHT THEN AND THERE!!! Then he was trying to talk me into paying a cancellation fee of 2 payment of $169. EACH!!!! the bank called me immediately while i was still on the other line with the guy!!! i asked him about the transaction and he denied that’s what was going on and even said “you must have a block on your card because the transaction wont go through NOW!!” my card was blocked for UNAURTHORIZED CHARGES NOT RETURNS to my account !!! I had to cancel my card, because they would NOT STOP charging it, they only try in the wee hours of the morning when Most honest Americans are sleeping. and to wake up and your money is gone when your trying to pay a bill or buy groceries or put gas in your car for work to wake up and your money that you were counting on is now gone!!!! That’s an tramatic experienc!!!! That whole experience was a true night mare for me. The months they took money from me and would not replace it was a horrible!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! HOW CRUEL AND THOUGHTLESS………………….     I ordered free trial, tried to cancel, they kept charging me for more that I didn’t order.I had to close my checking account and get a new account number and a new visa card.My bank charged for that also. Plus, I couldn’t get a new card for 3 months.

    the same thang happen to me!! The free 30 day trail turned in to a costly lump some of cash!! they keept sending it to me one after another!! then found out they were taking money off my debit care with out my permishion!! I called them and they said that i couldent return it cuz my trail was Over!! got like nine battles left!! it dont work anyway!! the Lady was so rude to me also!!

    My wife ordered the hydroxitone 30 day “risk free trial” and I paid for it with my debit card. She called and canceled about a week after ordering. They didn’t inform us that you had to send the product back they said it would be canceled. Needless to say I was charged 69.99. That’s when I called and the guy told me that basically my 69.99 was gone and he would wave the next payment. I had to get a new debit card about a month later, so then we start receiving notices that there was problem processing the payment, they were still trying to charge my card, and kept sending there product. I call again and now the girl is telling me your second shipment is covered you still owe for the second payment on the first order, and I said that’s not what I was told, I asked for her name she couldn’t give her last name and her supervisor was “sick”. That tells me right there that something is not right with this company. I would like to be added to the settlement. I don’t know if it should be in my name or my wife’s name. I’m glad someone is taking action against this company.

    I brought the Hydroxatone for my dark circles, they told me that I needed to use this product for about five- six months before I see results. I did not see the results. I stopped using it because it was getting to expensive.

    I was not seeing any difference for under eye dark circles. I felt it was not working. I cancelled order and was given a hard time getting them to stop shipment after demanding I didn’t want this product. I was only given a percentage of my money back.

    All of the following statements are true. No credit nor credit in time. Re-billed credit card. Product not as stated. Shipped products faster than you felt and would not credit. Do not want to give customer a credit. Lousy for a company to deal with. Sounds like it is going to be dragged out. We will all end up getting a product that we do not care for instead of our money and not be able to do a thing about it as it is already a class action suit. Not worth getting sick over.

    I received a 30 day free trial of Hydroxatone undereye cream. At week 3, I called them & said the cream has had no effects on my undereye bags, they said to keep it another 3 weeks free to see if it works. Well, 1 week later they did an automatic withdraw from my checking acct. of $79.80, I only had $12.00 in my acct. so I was overdrawn & a $34.00 fee. I was shocked & angry. I called them, what an ordeal I had to go through, finally a supervisor told me there was nothing they could do, after being on the phone with them for about 45 min. they credited my acct. but still out $34. that I can’t afford to lose. Am I entitled to anything from this lawsuit?

    I too have had to endure a similar situation to that which most of you have described…very frustrating & unfair, hence why when I received notice of a claim I felt completely just in partaking & filling out such back in June/July 2013…however I have NOT heard anything whatsoever in regards to status or reimbursement or anything for this case that should’ve at the very least had an update by now….the unjust craziness continues I suppose lol…

    I received a “Product Benefit” which is mainly alcohol. I would not spray this on my skin if it were free or not. I would like to have a cash benefit. Who can trust a company to offer a product benefit in a law suit to have the receivers best interest in mind? The KeraCalm Soothing spray is made with alcohol which dries out your skin. Wow! The stupidity.

    I was sent a post card informing me that I was in the law suit.I was to fill out form in which I never recived.I had requsted from what information was on the post card.When after being told last Friday(after many calls and being forwarded) I could still get this done.Again today I called ,to now being told it was to late.He said I had till the 15th of Aug.I don,t know if the young man dosen,t know what the date is.But i,m very disappointed.They stoled from me,not the other way around.Same on you!
