Many people who were exposed to asbestos decades ago are now seeing the full effects of this toxic substance. Plaintiff Stephen Windham of California is one of those having to live with the effects of asbestos exposure from long ago when he worked industrial jobs.
When Windham went to work on different industrial job sites, he was allegedly continually exposed to asbestos. At the time, he had no idea that he while he was working he was surrounding himself in deadly airborne asbestos fibers, according to his asbestos cancer lawsuit. Decades later, he received a diagnosis of incurable lung diseases that he alleges was a direct result of working at the industrial job sites that contained asbestos products.
His asbestos lawsuit names major companies including CBS and General Electric. The lawsuit alleges that withholding information about the dangers of asbestos was an ethical breach by those who employed him and operated the job sites. The asbestos lawsuit alleges that the companies responsible for the work of the plaintiff have a duty to reimburse him for his medical expenses.
The Asbestos Lawsuit is Stephen and Paula Windham v. General Electric Company, Case No. 4:14-cv-03849-PJH, in the U.S. District Court for the Northern District of California, San Francisco Division.
Asbestos and Lung Disease
During a time of investment into our country’s infrastructure, it was not uncommon for many construction workers to be exposed to asbestos. Praised for its sound absorption and affordability, asbestos was the primary choice of insulation building material, which meant that most construction workers were directly exposed to the dangerous substance for decades.
In addition, those directly exposed to asbestos have been known to have carried dangerous asbestos fibers on their clothes home with them, indirectly exposing their loved ones. Though rare, family members of industrial construction workers have been known to develop lung diseases that were later related to asbestos exposure, despite never having any direct exposure.
To complicate matters, the full effects of lung diseases, including lung cancer and asbestos mesothelioma, are often not noticeable for decades.
Construction sites as recently as 2002 have been known to contain asbestos products, despite being heavily phased out of the United States entirely.
In general, Asbestos lawsuits are filed individually by each plaintiff and are not class actions.
