A California Court has extended the deadline to submit a claim for a class action lawsuit settlement involving Emergen-C products, which plaintiffs allege were deceptively marketed. Consumers now have until Oct. 1, 2014 to claim up to $36 from the Emergen-C class action settlement.
The $6.45 million settlement was granted final approval on June 27, resolving allegations that Alacer Corp. made misleading statements about the immunity-, energy- and metabolism-related benefits provided by Emergen-C.
Alacer denies the allegations but agreed to refund consumers through a class action lawsuit settlement to resolve the litigation and avoid the expense of going to trial.
The Emergen-C settlement covers all U.S. consumers who purchased the following Emergen-C products in the United States between June 1, 2006 and Feb. 27, 2012:
- Emergen-C Original Formula;
- Emergen-C Specialty Formula products: Heart Health, Joint Health,
- Immune Defense, Lite with MSM, MSM, Vitamin D & Calcium, and
- ElectroMIX;
- Emergen-C Multi-Vitamin, Kidz Multi-Vitamin, and Emergen-C Kidz;
- Emergen-C Immune Plus; and
- Super Gram tablets
Class Members with Proof of Purchase can claim a maximum recovery of $36. Those without Proof of Purchase can claim up to $18.

The case is Crystle Wong v. Alacer Corp., Case No. CGC-12-519221, in the Superior Court of California, County of San Francisco.
