Halliburton class action settlementAccording to court documents filed today in Louisiana federal court, Halliburton Energy Services Inc. and Halliburton Company have agreed to pay $1.1 billion to settle the majority of the claims lodged against it following the 2010 Deepwater Horizon oil spill in the Gulf of Mexico.

Houston-based Halliburton was the cement contractor for the Macondo well beneath the Deepwater Horizon oil rig. The company has been accused of performing defective cement work on the well prior to the oil spill, which is the largest oil spill in U.S. history.

One year ago, Halliburton admitted to destroying evidence related to the oil spill and agreed to plead guilty to a criminal charge for the part it played in the massive oil spill disaster, which killed 11 workers.

The Deepwater Horizon oil spill settlement payments, if approved, will be held in a trust until all appeals have been resolved. According to the court documents, the class action settlement will resolve claims against Halliburton stemming from BP’s settlement of Deepwater Horizon oil spill claims filed by businesses and individuals who claim they suffered damage due to the oil spill. The Halliburton settlement also includes punitive damages claims by plaintiffs who allege they suffered property damage or suffered from the damage to the fishing industry related to the oil spill disaster.

In the oil spill settlement, Halliburton asserts that it is not liable for compensatory damages to Class Members of the BP Deepwater Horizon class action settlement. In 2012, U.S. District Judge Carl Barbier, who is overseeing the Deepwater Horizon oil spill multidistrict litigation, ruled that BP must indemnify Halliburton for compensatory damages related to pollution from the Macondo well.

The class action settlement also will not cover any claims brought against Halliburton by state or federal government.

Class Members of the Halliburton class action settlement include:

  • Individuals, businesses and other entities who had oil or other hydrocarbons in connection with the Macondo well or the Deepwater Horizon oil spill touch their real property or personal property between April 20, 2010 and April 18, 2012;
  • Charter boat owners and commercial fishers who were in business between April 20, 2009 and April 18, 2012; and
  • Individuals who fished or hunted in identified Gulf Coast areas to sustain economic security and basic needs including food, shelter and clothing.

 

Many of the Class Members will receive (or have already received) compensation for their economic losses through the BP oil spill settlement.

Halliburton retains the right to terminate the class action settlement if too few plaintiffs sign on.

BP is currently fighting the Deepwater Horizon oil spill class action settlement that it agreed to in 2012, arguing that it will be required to pay claimants who may not have been harmed by the oil spill. BP has appealed the class action settlement to the U.S. Supreme Court.
