GNC Corporation has been hit with a class action lawsuit accusing the nutrition company of falsely advertising that its dietary supplement TriFlex will promote mobility and flexibility, improve joint comfort and cushion joints.
California plaintiff Michael Lerma says GNC TriFlex, TriFlex Fast-Acting and TriFlex Sport products are promoted with a number of false advertising claims, including that they contain a “maximum,” “clinical strength” formula that supports “joint comfort,” promotes “joint mobility and flexibility” and “protects joints from wear and tear.”
In truth, he says, the TriFlex Products do none of this.
“Clinical studies have proven that the primary active ingredients in the TriFlex Products, glucosamine and chondroitin, are ineffective, taken alone or in combination with the other ingredients in the Products, with regard to the purported joint health benefits represented on the Products’ packaging and labeling,” the class action lawsuit says.
“Despite the vast weight of scientific evidence and clinical studies that definitively show the ingredients in TriFlex Products are ineffective,” GNC continues to convey to consumers that they have “maximum” and “clinical” strength formulas to promote mobility and flexibility, improve joint comfort, and cushion joints, the class action lawsuit continues.
Lerma says consumers who purchased GNC’s TriFlex Products were injured because “there is no other reason” for them to purchase the products other than to obtain the represented joint health benefits.
Lerma is seeking to represent a proposed class of persons in California and states with similar laws who purchased TriFlex Products from GNC. He is seeking restitution, injunctive relief, a corrective advertising campaign, and more.
The GNC TriFlex False Advertising Class Action Lawsuit case is Michael Lerma v. GNC Corp., Case No. 13-cv-00933, U.S. District Court for the Southern District of California.
