AllianceOne Text Spam Spurs Class Action Lawsuit Investigation

By John Curran

text message spamCell phones are ubiquitous in the United States, but many companies seem to think that marketing tactics like text spam are allowable. Some consumers have come forward to say they’re receiving these unsolicited text messages from debt collector AllianceOne. There are currently ongoing investigations into victims who may have had to deal with excessive AllianceOne text messages without having signed up for the notifications or advertisements.

These texts are illegal under the federal Telephone Consumer Protection Act (TCPA). While people who use landlines are likely aware that they can opt-out of robocalls from companies where there is no business relationship, cell phone users are similarly protected. This is an important regulation because while someone with a landline can let a call go to an answering machine, AllianceOne text spam costs mobile users money unless they have an unlimited plan.

AllianceOne is no stranger to allegations of TCPA violations. The company is on the road to settling claims that it made robocalls to existing customers and other consumers in spite of the fact that there had been no opt-in. The company agreed to pay millions of dollars to settle the claims. However, cell phone users should note that the fines are structured differently in the case of text spam. A single violation entails a fine of $500 per violation if mobile device owners can prove they did not ask for or sign up for these notifications.

Debt collection agencies are often the subject of allegations that they do not follow guidelines set by the Federal Trade Commission. For example, they cannot misrepresent themselves and cannot continue to harass people with debt or contact them at work if notified that an employer does not allow this. However, many still do and ignore laws like the TCPA, which are designed to protect all consumers, even if they owe companies money.

Whether you owe money or were randomly contacted by the company via text message, legal remedies are available. Get in touch with an AllianceOne text spam attorney for a free consultation. One is available at the TCPA Text Spam Class Action Lawsuit Investigation. You may be able to recoup money from the penalties or any ensuing class action settlements if AllianceOne does not want to go to trial. It costs nothing, so get your no-cost legal review today.
