A federal judge has approved a class action lawsuit settlement over allegations that Merck unlawfully promoted the sale of its painkiller Vioxx under Missouri law. Missouri residents who purchased Vioxx for personal or family use can file a claim to receive a one-time cash payment of $180 or $90 for each month they purchased Vioxx.
The Vioxx settlement will resolve a 2004 class action lawsuit, titled Plubell, et al. v. Merck & Co., that alleges Merck violated the Missouri Merchandising Practices Act by promoting and selling Vioxx, which was pulled from the market eight years ago due to evidence it doubled users’ risk of suffering a heart attack or stroke.
Plaintiffs in the Vioxx class action lawsuit detail a litany of alleged marketing abuses by Merck that ultimately put consumers at risk for serious side effects, they claim.
Merck denies the allegations but agreed to a class action lawsuit settlement to resolve the litigation.
Class Members of the Missouri Vioxx class action settlement include all Missouri residents who purchased Vioxx for personal or family use, except those claiming or who claimed personal injury as a result of taking Vioxx or who settled their claims about Vioxx previously.
Under the proposed Vioxx settlement, Missouri consumers will have two options for reimbursement:
- A one-time cash payment of $180 for those who cannot provide proof of purchase.
- $90 for each month of Vioxx purchases, with proof of purchase.
The only way to receive money from the Vioxx class action lawsuit settlement is to submit a Claim Form along with any supporting documents no later than October 7, 2013.
