A $9 million class action settlement that resolves allegations of numerous tablet and smartphone makers installing wiretapping software on mobile devices is now open.
Smartphone and tablet consumers who bought a device manufactured by HTC, Huawei, LG, Motorola, Pantech Wireless, or Samsung with service on AT&T, Cricket, Sprint, or T-Mobile are eligible to join this class action settlement.
The $9 million smartphone privacy settlement was granted preliminarily approval last month by U.S. District Judge Edward M. Chen, who found the agreement to be fair and reasonable.
In addition to the cash pay-out, the defendants also agreed to fix the Carrier iQ software bug that allegedly had the potential to collect data from millions of U.S. smartphones and tablets.
The settlement comes after a long litigation battle that started in 2011, when plaintiffs claimed that some of the largest mobile device manufacturers in the U.S. installed software that was capable of gathering user names, passwords, text messages and Internet searches.
Despite numerous attempts by the defendants to dismiss the 70 class action lawsuits combined into a multidistrict litigation, the case moved forward.
In August 2015, both parties engaged in settlement negotiations but struggled to finalize a deal. However, by January 2016, a proposed class action settlement affecting nearly 79 million smartphone and tablet owners was reached.
The smartphone privacy class action defendants continue to deny all allegations but agreed to the terms of the settlement to avoid the cost of further litigation.
Class Members who want to be exclude from the settlement agreement must do so by June 4, 2016.
UPDATE: On June 23, 2016, consumers in this privacy class action lawsuit against several tablet and smartphone makers urged a California federal court to accept a settlement that would resolve allegations that the companies installed wiretapping software on mobile devices.
Who’s Eligible
Carrier iQ settlement Class Members include all U.S. residents who purchased, owned, or were authorized users of certain phones and tablets manufactured by HTC, Huawei, LG, Motorola, Pantech Wireless, or Samsung with service on AT&T, Cricket, Sprint, or T-Mobile between Dec. 1, 2007 through Mar. 1, 2016.

The multiple smartphone and tablet manufacturers agreed to create a $9 million settlement fund. After court expenses have been paid, the remaining amount will be divided equally among all Class Members who file a valid and timely Claim Form.
