Top Class Actions has been following the Waggin’ Train class action lawsuits since 2012 when a grieving pet owner first filed a claim that the dog treats imported from China contained ingredients that caused his dog to get sick and die.
Nestle Purina tried to get the class action lawsuit dismissed in 2013 but a federal judge denied that request stating that the plaintiffs provided sufficient evidence to make a claim that the jerky treats were defective.
By 2014, Nestle Purina and Waggin’ Train agreed to pay $6.5 million to settle three class action lawsuits all claiming that the jerky treats were responsible for the illness and death of more than 1,000 pets.
Under the terms of the dog treat settlement, Class Members who were able to show documented evidence of financial loss due to veterinary treatment costs or death-related expenses would receive 100 percent reimbursement.
Class Members who could not prove economic damages would still be eligible to receive up to $300 per pet.
After an appeal for the settlement agreement was dismissed, the settlement administrator updated their site on Jan. 1, 2016 stating that the status was now in “appeal resolution” meaning that checks would be mailed soon.
Class Members of the dog treat settlement included all U.S. residents who purchased or obtained, or if your pets used or consumed, Waggin’ Train or Canyon Creek Ranch dog treat products imported from China or containing any ingredient imported from China.
The deadline to file a claim for the Nestle Waggin’ Train class action settlement passed on Apr. 1, 2015.
