SunRun Deceptive Marketing Class Action Lawsuit

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.


UPDATE 6/29/13: A federal judge has refused to dismiss the SunRun Deceptive Marketing Class Action Lawsuit, allowing it to move forward.

    Good Afternoon, my name is Ryna Lakhani & I purchased Sunrun Solar in 2022 when I got my new home. To begin with no one guided me about having an app for your company and I was not told or taught how to see if the Solar is working well or no and how frequently I have to to keep checking, like other companies like ADT & all did. There was absolutely nothing told to me by Sunrun Solar Agent and obviously being a common simple woman, I have no knowledge on this what so ever and was never guided either.

    I have been paying heavy bills to PG&E since the month of August 2023 not realizing that my Solar is not working until after the storm hit I happened to see my roof, the solar panels looked different to me compared to my other neighbors. When I felt that I guess it looks like a problem I contacted Sunrun via calls and was told by them that my Sunrun Solar has not been working since August 2023 until April 1st 2024 where the agent came to finally fix it after 2 prior appointments that were cancelled by them.

    Between that period on repeated recorded calls I was completely assured by the agents of Sunrun Solar multiple times that I will be given a credit check by mail for the loss of Solar from August 2023 till April 1st 2024. Every time I called I was assured about the same. I was then given a credit of 75$ by my case manager Samantha for those last minute cancellations by your Technicians.

    I received a bill of $1538.12 from PG&E & I was in a state of a shock this month. I called PG&E to ask them what kind of bills are being sent & they need to reduce that, I was told by them that since my Sunrun Solar is not working I have to call my Solar Company & request them to send me a check & help me clear my bill as they can’t do anything about it since I have used their energy. I then again called Sunrun Solar and was again assured saying, “You pay the bill now and we will together send you a check from August 2023 until April 1st that will include your this present bill too and you will receive this by mail.” I told them I did not have that kind of an amount to pay my PG&E bill and that I will have to borrow that amount, she said, “Yes you have to pay that bill and then this amount too 1538.12 will be added to my credit Sunrun Solar Check that they will send me.” When I asked how much would the total amount be? I was told they have to monitor my system since it’s recently fixed (April 1st 2024 it was fixed) and then they will calculate accordingly and send me the Check for sure & that I have to give them 24 to 72 hours for them to evaluate.”

    I like all the previous calls made a call & I had ALBERTO as my CASE MANAGER then, WHO WAS EXTREMELY UNPROFESSIONAL AND WAY TOO RUDE LITERALLY MAKING ME FEEL LIKE AS IF I WAS BEGGING HIM FOR HIS MONEY TELLING ME THAT I WON’T GET ANY CHECK FROM SUNRUN AND WAS VERY ABRUPTLY AND HEARTLESSLY TALKING WHICH IS NOT ACCEPTED AT ALL. I HAVE NEVER EVER IN MY LIFE EXPERIENCED SUCH A RUDE PERSON OVER THE PHONE WITH ZERO ETHICS AND SKILLS OF CUSTOMER SERVICE. I REQUEST THE HIGHER AUTHORITIES TO TAKE A SERIOUS ACTION AGAINST ALBERTO FOR HIS UNPROFESSIONAL CUSTOMER SERVICE.

    After being back and forth on calls on recorded lines with so many Sunrun Team Members & Case managers, I am listing a few of those names that I remember: Karson, Laura, Mike, Blake, Alberto, Samantha, Daniella, Joan, Liseth and more. Past few weeks many of them have only given me that assurance of me receiving the check from Sunrun for all my extra lost money paying PG&E for no fault of mine, I today so badly feel cheated by Sunrun for denying all the promises and assurance given to me, I am here to plead to the Higher Authorities to thoroughly look into my matter and bring Justice to me and my family. This check means a lot to us as we have loans taken to make payments for our PG&E bills which we need to pay back.

    After trusting Sunrun 100%, my this bad and heart breaking experience with Sunrun has put me through major mental stress causing me disappointment and i feel so badly bullied by the Team of Sunrun. I feel humiliated by Alberto causing me severe pain that made me cry profusely being ill treated. This honestly is not accepted and this matter needs to be escalated and throughly scrutinized, being fair to me, for my blind faith and trust in Sunrun.

    PLEASE GIVE ME JUSTICE IS A HUMBLE REQUEST. I KNOW SURUN IS A BILLION DOLLAR COMPANY AND I AM NOT HERE ASKING FOR ANY MILLIONS OR BILLIONS, ALL I AM PLEADING IS FOR MY HARD EARNED EXTRA MONEY THAT HAS GONE FROM MY POCKET. I WITH HIGH HOPE LOOK FORWARD TO RECEIVE A CHECK THAT SUNRUN WOULD MAIL TO ME ASAP AS A CREDIT FOR MY SOLAR NOT BEEN WORKING FROM AUGUST 2023 – APRIL 2024 INCLUDING THE AMOUNT OF $1538.12 AS PROMISED BY YOUR STAFF – THANK YOU.

    The solar was installed in May. It was not connected until November due to a Sunrun error in failing to submit the correct documentation in a timely manner. We LOST 5 months of potential solar generation during the warmer sunny months that would have helped offset the winter months.

    Plus we were told by Andrew Grose (the salesman) that we would get 2 months of no billing so there would be no overlap between Eversource and SunRun. What a lie.

    Yes, I did get one complementary month several months back, but that was it. I am now double-billed by both companies (SunRun and Eversource) causing financial hardship (which defeats the entire point of installing solar to begin with).

    To say I am unhappy with SunRun is an understatement. Given that the long connection delay was SunRun’s fault, I believe that SunRun should, in good conscience, offer us a minimum of 4-5 additional complimentary months in good faith until the sunny summer months can adequately do their job.

    Sunrun installed my solar in 2022 and it’s been nothing but a headache and has never worked correctly. For almost all of 2023 I was waiting for parts and was told that they were on back order , all the while making my $250 loan payment and my full electric bill payment. They would promise a phone call or email and never received any communication. They would schedule appointments and not show or tell me that things were fixed when they weren’t. I thought it would be a good company to go with because it was through COSTCO but I was wrong. Nothing but a nightmare.

    My mother was contacted by sun run in August of 21, a salesman named Frank convinced her that she would save a great deal of money by going solar. My mother passed away prior to it’s installation. I myself was contacted later by thee very same salesmen. He went on to convince me to purchase said system by telling me that my mother had already signed the contract and they were putting a lean on our home which he did . Before the install was even completed. And after he convinced me that according to the contract my mother signed they where entitled to the home.i told him I was on a very limited income and still he persisted that the only way I could save the home was to take on my mother’s debt. He gave me his word I would only be paying under $265 .00 pr. Month and during the summer my electric bill was around $4 to $500 a month. He spoke of all I would save. And went so far as to tell me they would reimburse me of anything over. I’ve still got all the e-mails and physical proof of the threats.I never even got the papers to file for my rebate from the government and my bill has increased to well over $300.00 a month. I would like them to get there’s too.

    They came to my house and took advantage of my Daughter who is mentally Challenge. They talked her into putting panels up on my house.When there already were significant amount of panels up there they had no reason to come and talk my daughter into it when she is not able to make those decisions. I was not able to make those decisions either because I’m suffering from Long-term.
    Covid memory loss. The man kept on 16 that my sister at panels.He said they were free and there would be no problem.Well, that’s not the case.He got paid as an independent for going around.Trying to get people to put panels up.You can take advantage of the mentally challenged

    I have similar issues with Sun Run and Mosaic the lending company. I have been paying for solar panels that are not connected for 4 years now. I contacted them several and they simply didn’t show up. We pay Edison and for the solar panels that are not connected.

    This lawsuit was in 2013. I can not find the current status – was it settled, is it still active, has it been dismissed, etc. From my experience, SUNRUN is mis-managed. There is no consistent company policy. One department does not know what another department is promising or doing. I did not want to take over this lease when we bought the house but am stuck with it and extremely unhappy. It is not performing and depending on who answers the phone, the response is either surly or uninformed. Any insights how to deal with SUNRUN would be greatly appreciated.

      I think we should put a petition against Sunrun I was told my electricity bills will greater than what I was paying back then in 2018 but since they came and installed those panels I never see any difference with or without they’re service
