Chase Loan Statement Fax Fee Class Action Lawsuit

JP Morgan Chase has been hit with a class action lawsuit claiming it unlawfully charged customers who have loans on a Georgia-based property excessive fees for receiving loan balance statements by fax.
Plaintiffs Dale R. Kaine, Stacie Sikes-Day and David Hartman allege in the JP Morgan Chase fax class action lawsuit that Chase and two of its former subsidiaries – Chase Home Finance LLC and Chase Home Finance Inc. – violated the Georgia Fair Lending Act (GFLA) by fraudulently charging customers unlawful and excessive fees for sending loan payoff statements via fax.
The max amount that can be charged for faxed payoff statements is $10 under the GFLA. Chase, however, charged the plaintiffs and other consumers $30 – three times the legal maximum allowance provided by Georgia law, the class action lawsuit says.
“Defendants represent the improper fees as legitimate charges and/or as recoupment of expenses incurred when, in fact, such fees constitute nothing more than pure profit or have no logical connection to the expenses actually incurred by defendants,” the Chase fax fee class action lawsuit states.
The Chase fax fee class action lawsuit is seeking to represent all persons or entities that paid a fee in excess of $10 to the defendants or any of their predecessors and affiliates, in connection with a payoff statement that faxed from Chase for a loan on a property located within Georgia.
It is seeking actual damages, statutory damages of two times the interest paid on each loan and punitive damages, and more.
The Chase Fax Fee Class Action Lawsuit case is Kaine et al. v. Chase Home Finance LLC et al., Case No. 12-cv-04483, in the U.S. District Court for the Northern District of Georgia.
