$1.8M Neutrogena Naturals Class Action Settlement Reached

UPDATE: The Court approved the Neutrogena Naturals Class Action Settlement at the August 21, 2013 Final Fairness Hearing. Claims will be paid within 30-90 days unless an appeal is filed.

 

Neutrogena Corp. has agreed to pay consumers $1.3 million as part of a class action lawsuit settlement concerning its line of Neutrogena Naturals products. Consumers who purchased the products can receive up to $10 each under the class action settlement.

The Neutrogena Naturals settlement will resolve a class action lawsuit, titled Stephenson v. Neutrogena Corp., that alleges Neutrogena deceptively advertised that six of its cleansers and moisturizers were natural even though they contain synthetic ingredients like petrochemicals, sodium benzoate, propylene glycol, glycerine and other unnatural components.

This is in direct contrast to marketing claims that Neutrogena Naturals contain “no harsh chemical sulfates, parabens, petrochemicals, dyes [or] phthalates.” The company’s website also described the products as “pure, natural skin care” that promise “real results,” the class action lawsuit says.

The only product in Neutrogena Naturals line that did contain wholly natural ingredients is the lip balm, plaintiffs allege in the class action lawsuit.

The Neutrogena Naturals class action settlement will require Neutrogena to change the labeling and packaging of its products in addition to paying $1.8 million in class compensation and attorneys’ fees.

Consumers who purchased Neutrogena Naturals Purifying Facial Cleanser, Purifying Pore Scrub, Face & Body Bar, and Fresh Cleansing + Makeup Remover since January 2011 will be eligible for $1 per purchase. Those who spent money on the company’s Multi-Vitamin Nourishing Moisturizer or Multi-Vitamin Nourishing Night Cream during the same time frame can recover $2 each. Rewards will be capped at $10 for each customer.

The case is Stephenson v. Neutrogena Corp., Case No. 12-cv-00426, in the U.S. District Court for the Northern District of California.
