weight loss surgeryThe cable channel TLC often shares the inspirational stories of women who have achieved incredible health goals on the show Skin Tight.

Most recently, the show featured the stories of two women, Megan B. and Yalena F. who lost a combined total of 434 pounds.

According to the show, even though the two women made huge accomplishments in weight loss they still suffered from low self-esteem as a result of the excess skin that remained after their weight loss.

Megan told People magazine that after losing all her weight she remained in a dark place emotionally and that she was disappointed with how her weight loss had destroyed her body. The emotional struggle with excess skin caused Megan to slowly begin gaining weight again.

The excess skin was so heavy it hurt her body and she needed to wear compression clothes to hold the excess skin in place. Then in 2015, Megan had loose skin surgery performed to remove her excess skin and her confidence and emotional happiness soared.

Yalena suffered a similar story. She described to People magazine the emotional and mental toll caused by her excess skin. After having her skin removal surgery, Yalena was thrilled with her new body and increased confidence.

Unfortunately, many women don’t have this same happy ending after accomplishing their weight loss goals because some insurance companies are refusing to cover skin removal surgery for patients who have experienced extreme weight loss.

In 2012, a Kaiser skin removal class action lawsuit was filed against Kaiser Permanente Insurance. Federal law requires heath insurance companies to cover surgeries that can correct abnormal structures of the body caused by disease if the surgery would create normal appearance or improve function.

The skin removal class action lawsuit alleges that Kaiser Permanente Insurance has been violating federal law by systematically denying requests for loose skin surgery after patients have undergone weight loss surgery.

The class action lawsuit was brought by plaintiff Wendy G. According to the lawsuit Wendy underwent bariatric surgery in order to treat her morbid obesity. After the surgery she experienced massive weight loss.

When she asked Kaiser Permanente to authorize her skin removal surgery Kaiser refused. After the refusal, Wendy initiated a class action lawsuit against Kaiser and is serving as the class representative.

Bringing a Kaiser class action lawsuit is an option for individuals who have been denied insurance coverage for loose skin surgery. A legal professional can help potential plaintiffs weigh the facts and circumstances of an individuals case.

Successful plaintiffs may receive compensation and retroactive payment for their skin removal surgery. Lawsuits like these also help hold insurance companies like Kaiser accountable to their customers. It reminds them that profit seeking behaviors cannot occur at the expense of consumer rights.

The Kaiser Class Action Lawsuit is Case No. RG12616206, in the Superior Court of the State of California for the County of Alameda.
