testosterone side effectsA testosterone product lawsuit has been filed by a Texas resident alleging that the testosterone gel product he was using led him to suffer from a heart attack and stroke.

Samuel McGuire filed the testosterone gel lawsuit against AndroGel manufacturer AbbVie Inc. as part of the larger multidistrict litigation (MDL) or mass tort that is currently underway. McGuire alleges that he sustained physical damages that required hospitalization after he used AndroGel.

McGuire was reportedly prescribed AndroGel with a 1.62 percent concentration of testosterone in March 2012 at the age of 65. He continued to use AndroGel to treat his low testosterone (low-t) condition until December 2012.

“On or about June 2012, as a direct and proximate result of using AndroGel, Plaintiff suffered from the injuries and damages alleged herein, including a stroke, heart attack and related sequelae requiring hospitalization, continuing treatment and medical monitoring,” according to McGuire\’s AndroGel lawsuit.

McGuire claims that had he known of the heart attack and stroke side effects associated with using AndroGel and other AbbVie testosterone products, he would not have used the product at all or at least limited how much and how often he used AndroGel to treat his low-t condition.

In this AndroGel lawsuit and in the larger MDL currently being litigated, consumers like McGuire allege that AbbVie Inc. failed to warn consumers of all product risks, was negligent, breached product warranty, committed fraud, and misrepresented their product.

McGuire is seeking monetary compensation for damages sustained, medical and hospital expenses, refund of product purchase, punitive damages for serious misconduct on the part of AbbVie, and payment of attorney’s fees, according to the AndroGel lawsuit.

History of Testosterone Products

In 1999, the U.S. Food and Drug Administration (FDA) approved the low-t treatment product AndroGel as a prescription medicine for hypogonadism, a condition common in older men that occurs when the production of testosterone diminishes as the male body ages.

Low-t can result in weight gain, loss of muscle mass, and a decreased sex drive. Because of these conditions, many middle aged men have become a niche market that companies like AbbVie can offer various testosterone products, like AndroGel.

Testosterone Product Side Effects

While these testosterone products offer many potential benefits to male consumers, AndroGel, Axiron, and other testosterone products and injections can also have many serious side effects including:

  • Blood clot
  • Enlarged prostrate
  • Heart attack
  • Stroke
  • Death

Additionally, there is a high chance of secondary exposure to spouses and children of AndroGel and testosterone product consumers.

“In 2009 the FDA issued a black box warning for testosterone prescriptions, advising patients of reported virilization in children who were secondarily exposed to the gel,” the AndroGel lawsuit explains. “Testosterone may also cause physical changes in women exposed to the drug and cause fetal damage with pregnant women who come into secondary contact with testosterone.”

There are several men pursuing testosterone product class action lawsuits for gel and cream testosterone products similar to AndroGel and testosterone injections, all which allegedly increase the chance of blood clots, strokes, and heart attacks in men over the age of 65.

The AndroGel Lawsuit is Samuel McGuire v. AbbVie Inc., et al. Case No. 1:14-cv-04626 in the U.S. District Court for the Northern District of Illinois. The Testosterone Product MDL is In re: Testosterone Replacement Therapy Products Liability Litigation, MDL No. 2545 in the same court.

In general, AndroGel heart attack lawsuits are filed individually by each plaintiff and are not class actions.
