Green Giant Valley Fresh Steamers Class Action Lawsuit

By Sarah Pierce

Valley Fresh SteamersA federal class action lawsuit claims General Mills’ Green Giant 100% Natural Valley Fresh Steamers frozen vegetables are not 100% natural. It is seeking over $5 million in damages for alleged false advertising/labeling.

Lead plaintiff Elizabeth Cox alleges in the Valley Fresh Steamers class action lawsuit that the product contains genetically modified organisms (GMOs) in the form of corn, soy, corn derivatives and soy derivatives that makes the labeling on these products false or misleading.

Cox says she purchased several of these products in September, including Green Giant 100% Natural Valley Fresh Steamers Roasted Red Potatoes, Green Beans & Rosemary Butter Sauce and Green Giant 100% Natural Valley Fresh Steamers Broccoli, Carrots, Cauliflower & Cheese Sauce. According to her class action lawsuit, Cox was damaged by the purchased because the labeling was misleading under California law and the product is less than what she paid for. Cox also claims she was harmed because she did not receive what she expected.

“The harmful impact upon members of the general public who purchased and used the product outweighs any reasons or justifications by defendant for the deceptive labeling and advertising practices employed to sell the product that misleadingly claims to be ‘100% Natural,’” the Green Giant Steamers class action lawsuit states.

The class action lawsuit is brought on behalf of anyone who purchased Green Giant Valley Fresh Steamers containing corn or soy ingredients from October 22, 2008 through the present. It is seeking of $5 million in damages for alleged violations of California’s Consumer Legal Remedies Act, Unfair Competition Law and for false advertising.

The Green Giant Valley Fresh Steamers Class Action Lawsuit case is Cox v. General Mills Inc., Case No. 12-cv-06377, U.S. District Court for the Northern District of California. The plaintiff is represented by represented by Benjamin Michael Lopatin of The Law Offices of Howard W. Rubinstein, PA.
