Naked Juice class action settlementNaked Juice customers who participated in a class action settlement reached last summer over deceptive marketing claims will finally see payments in the mail soon, according to an update by the Settlement Administrator.

Gilardi & Co., LLC said it began mailing checks for the Naked Juice class action settlement on June 23, and will complete the mailing over the next few days.

The money is part of a $9 million settlement reached in July 2013 resolving allegations that Naked Juice Co. engaged in deceptive advertising by labeling its products as “all natural” and “non-GMO.” Plaintiffs alleged in multiple class action lawsuits that Naked Juice products contained processed and synthetic ingredients, as well as ingredients from genetically modified crops.

Naked Juice denied the allegations but agreed to refund consumers through a class action lawsuit settlement to resolve the litigation and avoid the expense of going to trial.

Consumers who purchased Naked Juice products between Sept. 27, 2007 and Aug. 19, 2013 could claim up to $75 cash with proof of purchase or up to $45 cash without proof of purchase. Those amounts have been reduced pro rata, Gilardi said, due to the large number of Claims filed — a stipulation laid out in the settlement agreement.

The deadline to file a claim was Dec. 17, 2013. Class Members who submitted more than one claim will only receive one payment pursuant to the terms of the Naked Juice settlement and as ordered by the Court.

Class Members who had their claims rejected received notice of the rejection in January 2014, and had 10 days to challenge their rejection. Under the terms of the settlement agreement and under Court order, no further challenges to rejections will be honored, Gilardi said.
