Biomet is facing another hip replacement lawsuit over alleged problems with their metal hip implants.

A wife and husband have filed the metal-on-metal hip implant lawsuit against Biomet over allegations that the company’s metal hip implant is dangerously defective.

Plaintiffs Linda R. and Rick R. live in Las Vegas, Nevada. Their metal hip implant lawsuit holds that after Linda had a Biomet M2A Magnum Hip Replacement System placed into her body, she suffered hip implant complications due to the allegedly defective design of this artificial hip joint.

In July 2008, Linda had her left hip joint completely replaced by the Biomet M2A Magnum Hip Replacement System at the St. Rose Dominican Hospital in Las Vegas. After the surgery, she experienced pain and inflammation around the implant.

Her alleged hip implant complications ultimately required a hip revision surgery—a second surgery to remove the Biomet M2A Magnum Hip Replacement System and replace it with another hip implant.

The Biomet metal hip implant lawsuit contends that the Biomet M2A Magnum hip implant’s metal-on-metal design allows the metal surfaces of the joint to grind against each other. According to the Biomet metal hip implant lawsuit, this friction “shaves” microscopic flecks of metal off.

While the materials of the Biomet hip are normally safe in the human body, it is reported that these microscopic flakes are small enough to readily dissolve in the body, forming toxic metal ions which may inflame surrounding tissues. This can allegedly lead to inflammation that can cause pain and the failure of the implant.

Additionally, revision surgeries like the one Linda endured are a more complex procedure than a regular hip implant. During a regular hip implant, doctors remove the original bones of the ball of the femur (the top of the top leg bone) and part of the hip socket of the pelvis.

Since revision surgery is mostly a matter of replacing the implant, doctors have less of the original bone to work with. This makes the procedure more complex, in addition to any new challenges that arise from whatever condition led to the revision in the first place, such as infection or inflammation.

The hip replacement lawsuit holds that Biomet had ample evidence that the Biomet M2A Magnum metal hip implant was allegedly defective, in the form of post-market reports and research studies allegedly suggesting that the metal-on-metal hip joint was a defective design.

The metal hip implant lawsuit further alleges that Biomet had a duty to recall the artificial hip joint, and failing to do so led to Linda suffering severe complications from the Biomet hip joint, including pain, a hip revision surgery, and other problems.

The Biomet hip lawsuit seeks to recoup the cost of medical care; compensation for pain and suffering; legal fees; and other costs allegedly stemming from Biomet’s actions.

In fact, Linda and her husband are not the only people to make this allegation against Biomet. So many Biomet lawsuits have been filed that the legal system has coordinated them together through a process called a multidistrict litigation or MDL.

This means that all Biomet hip lawsuits are being organized through a federal court in Indiana, possible making it easer for people like Linda R. and her husband to file a Biomet hip lawsuit.
