Payless Champion Toning Shoe Class Action Settlement

Payless Stride Fitness toning shoesPayless ShoeSource, Inc. has joined the growing list of shoe companies reaching class action lawsuit settlements over so-called “toning” shoes. If you purchased any Champion-branded toning shoe from Payless between 2006 and 2012, you may be able to receive an $8 merchandise certificate from the Payless toning shoe class action settlement.

The Payless toning shoe settlement will resolve two class action lawsuits, entitled Laverne Hampton v. Payless ShoeSource, Inc. and Erin Brady v. Payless ShoeSource, Inc., that allege Payless engaged in untrue and deceptive advertising, promotion and marketing practices associated with its Champion-branded toning shoes. The toning shoes were marketed as being able to provide certain health benefits over regular shoes, which the Plaintiffs argued was not supported by scientific evidence and was simply untrue.

Payless denies any wrong doing, but has agreed to a class action lawsuit settlement to resolve the litigation. Similar toning shoe settlements have been reached with Reebok, New Balance and Skechers. Target is currently defending a class action lawsuit over alleged deceptive advertising of its TrimStep toning shoes.

Class Members of the Payless toning shoe class action settlement include all persons who purchased any Champion-branded style of toning shoes (including pod bottom and rocker bottom shoes) between January 21, 2006 and June 25, 2012. These shoes were marketed and sold under the names “Stride Fitness,” “Pace Swift Fitness” and “Pace Fitness.”

Under the Payless Champion toning shoe settlement, Class Members can file a claim to receive a single-use merchandise certificate worth $8 off the purchase of any footwear at any Payless ShoeSource store located in the United States or online through www.Payless.com. To receive this merchandise certificate, you must mail a Claim Form or submit it online at www.PaylessToningShoeClassAction.com postmarked or received no later than January 5, 2013.

    How is it that I am just now hearing about this? I purchased 3 pairs of these sneakers, of which I have worn very little. I wish that I had known there was a class action suit. I found out by searching for these shoes as I want to sell them. I suppose it’s already too late to be reimbursed for my purchase? Thank You. Susan Hardy
