Intelius Identity Protect Class Action Settlement

A $5 million class action lawsuit settlement has been reached with Intelius over allegations it tricked customers into enrolling into an identity protection service. If you subscribed to Intelius Identity Protect (IDP), you may be eligible to receive a cash refund or a voucher from the class action lawsuit settlement.
The Intelius settlement will resolve a class action lawsuit, entitled Bruce Keithly, et al. v. Intelius, Inc., et al., that alleges Intelius engaged in unfair and/or deceptive “in-cart” marketing practices, by which customers purchasing other Intelius products unwittingly enrolled in Identity Protect (IDP), a subscription-based service. IDP service was free for a short period of time (typically 7 days), then automatically converted to a paid subscription unless the customer cancelled the service. Monthly fees were charged to subscribers’ credit cards, the numbers of which had been provided during the initial purchase of an Intelius product.
Intelius denies the allegations, but has reached a $5 million class action lawsuit settlement to resolve the litigation.
Class Members of the Intelius class action settlement include all U.S. residents who subscribed to Identity Protect (IDP) from the first day the product was available until August 21, 2012 except for consumers who cancelled within 7 days (and thus were never charged) or have already received a full refund from Intelius.
There are three categories of Intelius settlement Class Members:
Category 1 – Consumers who enrolled in IDP before August 12, 2009, and did NOT activate IDP benefits. These Class Members are eligible to receive cash equal to 100% of the amount charged for IDP (subject to pro rata reduction if total claims exceed the Fund’s value).
Category 2 – Consumers who enrolled in IDP on or after August 12, 2009, and did NOT activate IDP benefits. These Class Members are eligible to receivevouchers worth $53 or 70% of the amount they were charged for IDP (whichever is greater). If the cash portion of the Settlement Fund is not depleted by Category 1 claimants, Category 2 claimants may also be entitled to cash equal to 30% of the amount charged for IDP, subject to a pro rata reduction if these additional claims deplete the Fund.
Category 3 – Consumers who enrolled in IDP before August 12, 2009, and DID activate IDP benefits. These Class Members are eligible to receive vouchers worth $53 or 70% of the amount they were charged for IDP (whichever is greater).
