Pure Via class action settlementReaders are reporting that they are receiving checks in the mail from a class action settlement stemming from allegations Pure Via Natural Sweetener products were deceptively marketed.

According to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Pure Via settlement began receiving checks worth as much as $22.96 on Nov. 23, 2015.

The Pure Via class action settlement resolves allegations that Whole Earth Sweetener Company LLC and Merisant Company deceptively marketed their Pure Via All Natural Zero Calorie Sweetener. The plaintiff claims she was misled by the statements on the product label, and that Pure Via could not be called “natural” because it contained ingredients that were “highly processed.”

Whole Earth and Merisant deny that the marketing, advertising and/or labeling of Pure Via sweeteners is false, deceptive or misleading. However, they agreed to settle the Pure Via labeling class action lawsuit to avoid the risk and expense of trial.

Class Members of the Pure Via settlement include U.S. residents who purchased Pure Via products between Jan. 1, 2008 and Oct. 6, 2014. Under the terms of the Pure Via class action settlement, Class Members were eligible to claim a maximum of $30.

In addition to providing cash benefits to claimants, the defendants also agreed to alter the product labels to remove the allegedly misleading statements. They also agreed to make significant changes to their marketing and to include more information about the Pure Via ingredients and the process used to make the sweetener on the product website.

The deadline to file a claim for the Pure Via class action settlement passed on Feb. 10, 2015.
