By filing an Unum lawsuit, a Kansas plaintiff is seeking short-term and long-term disability benefits she had previously been denied by Unum Life Insurance Company of America.
The plaintiff, Casey S., alleges in the Unum lawsuit that she had been provided shor-term and long-term disability coverage at her place of work under plans insured by Unum Insurance.
The Unum lawsuit claims that Casey became disabled, and was consequently no longer able to work. After being forced to leave work by her disability, she filed a claim for short-term and long-term disability benefits. According to the bad faith insurance lawsuit, Unum unfairly denied Casey’s legitimate claims to both long and short-term disability benefits.
Casey states in her Unum bad faith insurance lawsuit that she did everything in her power to fix this problem before going to court, including appealing the denial in an attempt to resolve the issue. However, Unum has still failed to provide the additional short and long term benefits Casey is allegedly due.
Because Unum is both the insurer of the plan and the one responsible for determining the legitimacy of Casey’s disability claims, the bad faith insurance lawsuit claims that Unum’s claim denial was done under a conflict of interest. This conflict of interest, according to Casey, significantly influenced the claim denial decision, and was not based on substantial evidence. The Unum lawsuit further alleges that Unum’s claim denial was reached through ignoring relevant evidence, as well as relying instead on biased information.
Casey hopes that by filing the bad faith insurance lawsuit, she will be awarded the short- and long-term disability benefits she was previously denied.
