benicar-diarrhea-discomfortA Louisiana resident filed a Benicar lawsuit against Daiichi Sankyo, Inc., alleging that the company failed to adequately warn him of the risks of using Benicar.

The 87-year-old plaintiff was first prescribed Benicar in 2008. The man’s Benicar lawsuit alleges that use of the drug directly caused multiple injuries, including chronic and severe diarrhea, kidney damage, kidney failure, gastrointestinal tear, blood transfusions, and psychological damage.

The plaintiff also claims that these conditions have forced him to endure economic loss, emotional distress, and loss of enjoyment of life. The plaintiff claims that these conditions necessitate medical monitoring, and will continue to cause him pain and suffering in the future.

The Louisiana man filed his Benicar lawsuit on multiple counts, including design defect, failure to warn, gross negligence, fraudulent concealment, breach of express and implied warranties, and unjust enrichment.

What is Benicar?

Benicar (olmesartan medoxomil) is a popular drug used to treat hypertension. Benicar has recently been associated with multiple medical complications which have sparked a series of lawsuits over the alleged failure to adequately warn consumers of the risks.

Benicar tablets were first approved by the U.S. Food and Drug Administration (FDA) to treat hypertension in 2002.

On July 3, 2013, the FDA issued a Drug Safety Communication warning that Benicar, also sold as Benicar HCT, Azor, and Tribenzor, can cause several severe complications including chronic diarrhea and gastrointestinal issues.

Several studies have shown a connection between olmesartan medoxomil and gastrointestinal problems, including a study published by Mayo Clinic researchers in 2012.

Benicar Lawsuits

Many Benicar lawsuits have claimed that Daiichi Sankyo failed to perform reasonable and necessary clinical trials to determine the effects of longer term cumulative exposure to olmesartan.

Plaintiffs in these Benicar lawsuits also claim that Daiichi Sankyo has, over the years, marketed Benicar products in false or misleading ways which omit and/or minimize the potential risks associated with the drug.

Despite knowledge of the risks, the company allegedly continued to make claims as to the efficacy of their products, but did not conduct any clinical outcome trials that would prove this efficacy.
