SCUPS Class Action Lawsuit Settlement

Southern California University Professional StudiesIndividuals who enrolled in Southern California University for Professional Studies may be able to participate in a class action lawsuit settlement if their enrollment was terminated (voluntarily or involuntarily) and they did not receive a pro rata refund of their tuition. Under the terms of the proposed settlement, Class Members can receive a voucher for free tuition for a certain number of credits.

The SCUPS settlement will resolve a class action lawsuit, entitled Patricia Lee v. Southern California University for Professional Studies, that alleges SCUPS did not refund some students all or part of their tuition upon termination of their program in the school. According to the class action lawsuit, SCUPS misrepresented in its literature how it would calculate a refund, so that former SCUPS students who did get a refund did not get the right amount and those former students who did not receive a refund are entitled to one.

SCUPS denies the allegations but has agreed to a class action lawsuit settlement to avoid the hassle and expense of ongoing litigation.

Class Members of the SCUPS class action lawsuit settlement include all individuals who enrolled in Southern California University for Professional Studies pursuant to a written enrollment agreement not containing an arbitration clause, who paid tuition and then terminated (voluntarily or involuntarily) from their program at SCUPS, and did not receive a pro rata refund of their tuition less the application fee, and who either (a) terminated their program of study having completed 60% or less of the program of study; or (b) did not request all materials in writing after having received the first lesson.

Under the terms of the proposed SCUPS class action settlement, each Class Member will receive a voucher for free tuition for a certain number of credits. The number of credits will be between 1 and 5, depending on the total amount of tuition paid by the Class Member, less any refund already received. The value of one credit is equal to an amount ranging from $250 to $330 depending on the program that the voucher is ultimately used for.

Class Members will automatically receive these benefits unless they opt out by August 31, 2012. There is no claim form necessary to participate. A Final Approval Hearing is scheduled for October 24, 2012.
