Huffington Post Text Spam Class Action Lawsuit

By Kimberly Mirando

The Huffington PostAn Illinois woman has filed a class action lawsuit against TheHuffingtonPost.com for allegedly bombarding people with text-message news alerts at all hours, despite their repeated requests to stop it. She is accusing Huffington Post of violating the Telephone Consumer Protection Act (TCPA), which prohibits companies from sending unsolicited automated calls to cellular phones. Violating the TCPA carries a $500 penalty per violation.

Plaintiff Alicia St. Leger alleges in the Huffington Post class action lawsuit that she signed up for the site’s “Daily Brief” news summary service expecting to receive one text message a day. Instead, she got multiple text messages a day, which her wireless carrier charged her for. She says Huffington Post ignored her repeated requests to unsubscribe, and continues to send her multiple unwanted text messages at virtually all hours of the day.

The Huffington Post text spam class action lawsuit is brought on behalf of all persons in the U.S. and its territories who received one or more text messages from the Huffington Post or its agents after requesting that the text messages cease, or after otherwise communicating that the company did not have consent to send any text messages to that telephone number.

It is seeking an award of actual and/or statutory damages, an injunction barring Huffington Post from sending unauthorized text messages, attorneys’ fees, court costs and more.
