Mini Cooper transmission defect class action settlementThe legal rumblings over allegedly defective BMW Mini transmissions got even louder this month when a second class action lawsuit was filed against the automaker. The new BMW Mini class action lawsuit, filed by Florida Plaintiffs, joins a California class action lawsuit filed last year by owners frustrated at how Mini dealers are handling – or not handling – the situation, leaving owners with unresolved issues and thousands of dollars in repair bills.

Both groups of Plaintiffs allege in the class action lawsuits that certain BMW Mini Cooper vehicles contain a “manufacturing defect” in the continuously variable transmission (known as CVTs) that causes premature transmission failure.

According to the new Mini Cooper transmission class action lawsuit, filed in the U.S. District Court in Miami, the problem affects 2002-2005 Mini Cooper hardtops, and 2005-2008 Mini Cooper convertibles. The class action lawsuit includes vehicles sold in Florida and alleges BMW violated the state’s Deceptive and Unfair Trade Practices Act.

A previous class action lawsuit filed in September 2011 in California, known as Brad Aarons v. BMW of North America, LLC, is seeking restitution, damages and other relief for owners who faced the same CVT transmission failures. Some of the Plaintiffs in the lawsuit alleged they spent between $6,000 and $9,000 to have their CVTs repaired or replaced – almost a third to a half of the original purchase price they paid for the vehicles. Some Plaintiffs couldn’t afford the repairs and had to sell their vehicles, suffering major losses.

UPDATE: Judge Gutierrez preliminarily approved a MINI Cooper Transmission Class Action Settlement. Details on how to file a claim will be available soon.

UPDATE 2: Notices and claim filing instructions for the MINI Cooper settlement are being delayed by disputes between the two parties. Both sides asked the Court to intervene to expedite administration of the class action settlement benefits.

    power…this is what happened to me…imagine having no power…imagine processing this in your brain..imagine how you must manage a lifeless car out of the way of hundreds behind you…i don’t mean 5 cars or 20 cars or 40 cars, I mean hundreds of cars behind you.and hundred more behind them…..and these cars are not driving slow…i am here to confound you,
    with the dangers of this BMW product…these thick headed little peckers at BMW…goodgawd…what does it take….freeway fatalities????…i am just thankful to here so I can purchase a 6000-7000-8000 $$$ transmission..

    My name is heather Coram I live In canton Ohio I have a 2003 Mini Cooper hard top the transmission went out at 89, miles and I owe 10, on it yet called corporate they said there is nothing they can do about it cause its not under warranty I hope there is a recall on all these mini cause its ridiculous it was my only vehicle to drive to work now I have to find rides to work and pay on a car that I can’t even drive someone please help me can’t afford to fix it ready to go to the news with this thanks heather I’m going to let everyone know about BMW half fast jobs on the mini coopers

    My 2002 mini’s transmission just failed and it’s $8,000 to replace it. This will be the second one I’ve replaced. The first one was within the warranty period so I didn’t have to pay for it. I want to be a member of the lawsuit as I feel totally abused by Mini.

    Problem is the owners manual for my 2007 mini states to not add a quart of oil until the oil light goes on or the dip stick indicates. it. No where in the manual does it say to check the oil at any interval. Additionally, the illustration of the dipstick does not match what’s in the car. easy to think you’re full but actually two quarts low. Had timing chain replaced twice and both occasions due to lack of oil.

    I have a 2005 mini cooper S the transmission started malfunctioning. It cost 800.00 to just get the transmission fluid changed. The shop machanic said that the fluid was only a little low with very few shavings.That it should fix the problem.Needless to say its still messed up and sitting in my garage.Baton rouge La dealer ship wants 10,000.00 to replace the transmission and where ! I didnt pay but 13,500.00 for the car. They are unsafe. without warning the transmission just started failing and my 19 year old daughter nearly got run over on I-55 i nterstate! Somebody please tell me how to join this lae suit claim!

    Is the Mini Cooper class action still going? I want in on this. Conveniently and timely, my transmission decided to die as soon as I made my last payment for my car. How ironic is that. I know it will cost anywhere between $5,000-$9,000 to fix. This is bullshit. I can’t even recover the value of the car at this point because it’s not running. I am so angry. How does a 6 year old car get to this point? Don’t even get me started about the overheating issues.

    I would like to know who to contact about this CVT failure, I have a 2007 Cooper Convertible that i bought used about 2 years ago I am still making payment on it the 36,000 mile warranty has ran out. I have the window sticker where mini was first bought, its says Braman Mini of Miami. The Mini has started to make a grinding sound and my Husband thinks its the CVT.     I purchased a 2003 mini cooper with 104,000 miles in the Dallas, Texas area. I just received the dreaded news today that my transmission is going out and it will cost me $6000 to repair. I bought this car used and according to the history the transmission was changed during the warranty period so this would be the 2nd transmission for this car. They are crazy if they think I’m going to cough up $6K for this…aren’t we in a recession??? Well it’s now a depression in my home after this terrible news.     mini coop 2007 convertable , it first had trouble several months after I purchased from dealer, (bought dealer driver 7K mls) I took it in and they did some adjustments and stated I needed to switch from manual to standard several times a week to keep trans working order. (what was this all about) then while on drive to MI broke down in Elkhart, had to have towed to Indy for repair, (car was still under warranty) they stated it was fixed, cost me rental car,tow,repairs(said warranty would not cover this ??) picked up and drove 1 hour and pow, did all over again but this time worse. other mechanic stated the bolts for engine were not put back tight . we debated the charges on the cc but were finally told that I would have to honor the bill and still would be owing for repairs. I had paid so much in advance in car payments that I did not have car payment for almost 1 year after this. I was trying to see what I could do in mean time. but finally just paid it off . very frustrating expecailly since it was still under warranty and had had problems in the first place. we took to BMW dealer as we were told to do by Cooper of Dallas because of the warrenty issues, all of this happened while I was in strange town w no relatives, no way to get around and 65 years old. not a nice picture.
