U.S. Bank overdraft settlementU.S. Bank has agreed to pay $55 million to settle a class action lawsuit accusing the bank of charging improper overdraft fees. The U.S. Bank overdraft fee settlement is just the latest to be reached in a multidistrict litigation (MDL) involving more than 30 different banks nationwide, entitled In re Checking Account Overdraft Litigation.

The U.S. Bank overdraft fee class action settlement will resolve allegations the bank improperly manipulated its customers’ debit card and ATM transactions by posting them in highest-to-lowest dollar amount rather than in the actual order in which they were initiated and authorized. The illegal practice was allegedly performed in order to generate excess overdraft fee revenues.

“We are pleased to have achieved this result for U.S. Bank customers who were adversely affected by this anti-consumer practice,” said the Plaintiff’s coordinating counsel. He said he expects the proposed U.S. Bank overdraft fee class action settlement to be presented to the Court for preliminary approval within 90 days.

U.S. Bank is not the first bank involved in the MDL to settlement similar claims. In addition to a $410 million settlement with Bank of America approved last year, class action overdraft fee settlements with JPMorgan Chase Bank ($110 million), Citizens Bank ($137.5 million) and PNC Bank ($90 million) have been announced in recent months. At least nine other banks have settled.

UPDATE 1/2/14: There is no claim filing process for the U.S. Bank overdraft settlement. Class Members will automatically receive an account credit or check if the class action settlement is approved. The Settlement Administrator has posted the following update:

The Final Approval Hearing was held on December 18, 2013.  Following the presentations of counsel, the Court announced its intention to grant Final Approval to the Settlement, to award Service Awards to the twelve (12) named Plaintiffs, and to award Class Counsel attorneys’ fees equal to thirty percent (30%) of the Settlement Fund plus reimbursement of certain expenses.  The Court has not yet entered a Final Approval Order and Final Judgment.  This website (www.usbankoverdraftsettlement.com) will be updated again as soon as the Final Approval Order and Final Judgment are entered by the Court.

 

UPDATE: 2/20/14: The Settlement Administrator has posted the following update:

On January 6, 2014, the Court granted Final Approval to the Settlement, and on January 15, 2014, the Court entered Final Judgment.  In the event there are no timely appeals, the Effective Date will be February 24, 2014, and distribution of awards to eligible Settlement Class Members by account credit for current customers or by mailed check for former customers will occur no later than June 24, 2014.  This site will continue to be updated as specific dates and details regarding distribution become available.

    The majority of banks do this… why hasn’t there been a law passed to stop this illegal practice? How convenient for banks to only pay up when they have to reach a settlement, and only to those who know about these settlements instead of having to stop it all together.

      i was cashing my checks at walmart or another store customer service center and putting cash deposits in the atm at us bank. to my understanding these cash deposits were to be entered into the account within 24 hours of the deposit. none of these deposits for over 4 years were in my account sooner than 5 days. i would make the deposit on thursday or friday at the lastest each week none would be in my account before the following wednesday in the mean time they would charge my account and my hadicapped daughters account as many charges as they could before they put the cash i had deposited in the atm the previous week into my accounts, this just detroyed my health and my relationship with my daughter the stress of being ripped off like this openly and agressively each week sent me to the hospital at least tree times for a total of over 20,000 dollars in medical fees.i also had to pay a fee to cash all my checks at a check cashing facility this in itself add up to over a 1,000 dollars for fuel to drive to the faclity and then pay to have my check cashed and then still pay unprecidented fees constantly because they were violating federal law which stated that all cash atm deposits had to be represented on that accounts books within 24 hours. in my opinion it would be difficult to repay me for the damage they caused to my health and my family.all i wanted therm to do is put my money in my account when it was suppose to be on the books. i would question them about these actions every week for the years that this went on
      , and nothing came of it till this law suit was filed , but im still paying off the loans i got to pay the medical bills that this unlawful act generated

        I have had the same experience with Key Bank, but there has never been a lawsuit against them yet. that’s why we switched from usbank and Key bank to a smaller bank of dollarbank. the are not out to make money on us

            US bank filed yet another appeal, they have been dragging this thing out for 4 years. I almost lost my apartment 8 years ago due to these practices…I was making barely above minimum wage and they put my electric bill payment through before several small transactions that were made before I even received that bill! So, it had been about 5 or 6 days since I used my account before I paid that bill. I knew that the charge would overdraw my account by about $10, but I couldn’t wait or my power would have been shut off; instead, seven or eight transactions that were just over $1 were charged after the check and caused my account to be overdrawn by almost $300 instead of $40(which my dad was depositing to cover the charge the day after I paid my electric). I ended up short on my rent and had to make a choice that month between having my prescription medications and having food or having a roof over my head. I went the month without my medication and ate nothing but ramen, and never even got do much as an apology in my dozen or so calls to the bank to get this issue fixed.

        Bought a money order from a gas station, realized that it was not needed after all, tried to get the money back from the gas station, they could not do it, took the money order to my US Bank tried to cash it there, the teller told me that she could only deposit it. I asked if the funds would immediatly be available, needed to get gasoline and some groceries, the teller assured me the funds would be available instead of just giving me the cash she said she had to deposit it. Left the bank to get gasoline and some groceries, several days later, my US BANK account went into a overdraft situation cuasing my account to go into a spiral of charges and fees. The account had to be shut down to stop any further penalities, then there was this huge left over balance of charges and fees. Learned later that even though this class action law suit is addressing the way the US Bank handles their overdrafts, if there are any funds or rewards due, that those funds due from the class action law suit to the customer would be applied to the US Bank if there are any further charges pending on a customers account.

        On January 6, 2014, the Court granted Final Approval to the Settlement, and on January 15, 2014, the Court entered Final Judgment. On January 30, 2014, a timely notice of appeal was filed. Therefore, the Effective Date was no longer the previously-referenced February 24, 2014. On June 24, 2014, the Court issued an Order dismissing the appeal, and the Effective Date is therefore July 1, 2014. We do not yet have a specific date available for when account credits will be applied in instances of open accounts, or when checks will be mailed for former accounts. We appreciate your patience as we work to distribute funds in advance of the October 29, 2014 Court deadline. This site will continue to be updated as specific dates and details become available.

        Excuse me. That is generalizing sir. Who said overdraft charges were illegal I do not know. I do not think they are illegal but what I do not appreciate is when my transactions are purposely re-ordered to ensure the largest transactions is put through first no matter if that transaction occurred first.

        I was told they did it for our own good as they figure we would want things like mortgage, car payments etc to have first priority over coffee and gas. In reality they wipe out the account with the large transactions and let the smaller charges overdraft and rack up fees.

        My yearly website payment went through and of course I forgot it was going to. The time it posted was around midnight. I had multiple transactions that occurred that morning that had enough funds but instead of posting in order of occurrence they put through the website payment, which I didn’t have enough to cover and bounced 10 prior transactions at $35 each.

        If they had processed in order I would have paid one overdraft charge and had to make up the shortage amt and been done with it.

        I do not use payday loans but I have made errors and been short from time to time. I do not appreciate the underhanded exploitation or financial hardship it causes nor do I care for the BS as they claim they are looking out for the acct holder with this policy.

          I certainly can relate. It is a shame that some people can be so insensitive of others misfortune. That’s something that is said by someone that may have been born with a silver spoon in their mouth or maybe even worked hard for it. It still does not give one the right to judge others. For the previous comment, I had 7 payday loans out in which I paid off already. I had the worst news of my about my mom passing then soon after my uncle. Recently I lost my dad. No one knows others situation so they should NOT judge. Just keep it to yourself.

        This is an uninformed comment. The issue is whether US bank breached a fiduciary duty to its customers by purposefully manipulating the order in which transactions are processed. Most banks process items in the order it was received. US Bank, in an effort to enrich itself processed the highest transactions first to increase the chances of causing a customer’s account to go negative. They also processed debits first before they processed credits (deposits). I learned this by asking my personal banker at US Bank why my business account was constantly being hit with fees that drained my account and caused further charges to incur. She told me this in confidence and later quit working for US bank.

        I also use online banking and was able to transfer money between accounts to avoid this very issue. I transferred funds from my savings to my personal checking on a Friday. That money, while no longer available in my savings account, was not processed into my checking account ensuring that fees would accrue.

        While this practice may not yet be illegal under US banking laws, it sure smacks of underhandedness as many courts have agreed in certifying class membership. Customers should be able to trust that their selected bank is not doing anything to undermine their financial position for the bank’s own financial gain. It isn’t a contest of how much the bank can make off of you before you can utilize your own funds but it certainly feels that way in today’s banking climate.

        I believe this practice should be made illegal or at the very very least provide full disclosure of this practice in plain language for customers to make a decision on their own. I’ve since switched banks 4 years ago and I have not had this problem since. It’s wonderful that someone finally smacked the banks although the settlement for US bank should be larger given all the high rise banking buildings that have popped up around major cities with USBANK emblazoned on it.

        Anyone who doesn’t understand this is likely to become easily victimized themselves.

        I don’t think they are complaining about the actual overdraft fees. It was the way they processed the payments that was unfair. If you have checks or charges out there for instance, one for $185 and one for $40, $30, $8, $13, $32 etc and you had $200 in your acct. They would approve the $185 charge and the $8 charge and charge you an overdraft fee of $36 for the other 4 payments instead of clearing all of the smaller charges and charging you 1 overdraft for the $185 check, They made a lot of money by practicing this way!

    I was just charged with Deposite account fraud for overdrafted account which came from fees which were charged in the same way the lawsuit say they do business. They will have a warrant made and I will have to turn myself in to sit in a Jail for their illegal unfair business practices. From the looks of this lawsuit they should be paying me and are trying to charge me to prevent me from joining in the settlement of the class action. They contunuiously charged me daily overdraft fees for an account only overdrafted by their overdraft fees for charges they waited to post until my account would overdraft.

    I too do not have an account with them anylonger because at one time I found that they did what this suit is about, I went to my branch and they told me that they could not do anything for me it was the way they came in for them to pay, I told they that was wrong I was living check to check at the time I used every penny I could but to be sure I did not go over what I had in my account,but they did not care so I closed my account and took a big lost because they keep taking my check to pay the overdrafts that should not have been. I hope I get everything back that would be so nice!!!!!!! I now bank with dollar bank and no trouble with them at all

    Payments will be automatically credited to your U.S. Bank account or (if you no longer have that account) by check mailed to the address U.S. Bank has on file.

    The amount of money you can receive from the U.S. Bank overdraft settlement will depend on the number of overdraft fees you incurred. Only a small percentage of all overdraft fees that were charged by U.S. Bank were affected by high to low posting. So, not every overdraft fee that was charged is eligible for payment under this class action settlement.

    A Final Approval Hearing is scheduled for December 18, 2013.

    I am relieved that something is being done to stop bank corrupton. During my time with US bank, I lost more money than I was making at the time. I felt as if I was being robbed every time I went in to the bank. At the time, I had a new born and two young girls and this affected me greatly. I would like to say thank you. Some one is standing up for the back bone of this country- The working man. Those of us who scrape by week to week do not deserve the treatment laid upon us by corrupt corporations who try to rob us of money when we do not have it in the first place.

    Thank you for looking into this. Problems are still ongoing. When payments are made through online banking, money is not taken from the account at the time the bill is paid. About a week ago, my balance, and available balance, was about $800.00. I withdrew $200.00. On the following morning, my balance was negative by about $178.00. Of course, I was charged with 2 overdraft fees.

    I have had conversations on te phone and in person about their overdraft policies and in the end stealing from customers that trusted their name. I have been to events that US bank puts on and they have plenty of money to throw away on huge parties and huge paycheck to the suits! They take money from trusting customers to line their satin pockets with green Cotten called the almighty dollar. I hate to break it to people including myself with a 55 million dollar settlement most will only see a few dollars if that. I believe it is around $.37 on the dollar for charges. I saw a settlement for B of A that was over 100 million dollars and the average person got around $37. Where does the rest of the money go? That I am curious. The lawyers get rich, that is for sure. So again…. The customers basically get spit on again. Most overdraft fees are not just that but also include fees from the individual companies which many have hefty fees themselves. None of that is taken in to consideration. So really, the heartache of the stealing from US bank plus the heartache from all the other companies is not taken into consideration. I know I am not te only one that thinks giving around 14% out of 55 miilion that goes to lawyers such as other bank settlements is wrong. Why do they get all the money when the customers that the criminal act was done to gets pennies for their pain and suffering. Something is very wrong and should be changed. The customers should get more than just a couple dollars. Doesn’t even make sense and is wrong as well. So the lawyers win again and also US bank another big bully like so many other big corporate big wigs that have no heart and soul. We can all thank US bank or stealing from us and giving us nothing in return. US bank suits will get what they have given. Regardless if justice is ever done. What goes around comes around. If I was in charge of this case and how much money customers who have been wronged get, I would think carefully about it and do the right thing not just what makes their bank accounts full.

    I had to answer to you one more time because I had to know if they just pay the customer the settlement if they owe them or I need to know if they suggest paying the old accounts off, if they exist in the charge off departments, because if they exist they’ll probably pay mines off, like they always do to embarass me or try to, in collections offices, but I think my overdrafts were over two or three thousand dollars, and my guess may be wrong, but I would still probably have something, or anything left.       I guess you don’t know what was happening with these overdraft fees. Let me explain. Instead of declining a transaction if your account did not have the funds, the bank was allowing it to go through and would charge an overdraft fee. Even after calling the automated line for your balance saying you had money you would get a charge for insufficient funds. This would usually happen over the week-end and you would find out on the following Monday or Tuesday that you had all these fees.

      This person must work for US Bank, that is there standard reply. I am very accountable of my funds, there is no way you can balance with unforeseen charges. I didn’t have a 6.95 service fee and then all of a sudden I have one. Then I get a 12.50 service charge to transfer funds from savings to my checking, then automatically it is reverse. Without my authorization they transfer funds from my checking into savings, which triggers overdraft fees of $36 times 7, because I used my money with my debit card that I deposited into my checking account. I would not have spent funds I did not have, the bank choose to make my money unavailable to create over draft fees. This last month they took $252 in Over draft fees, I could not figure it out or able to explain to my husband where our money went. These fees just started showing on my on line banking this last week, and it was a brutal hit. They encourage you to go paperless and use online banking, and when they steal your money, they blame you for depending and trusting online banking. This is insane and you can not defend your credits or debits.

    I just found out about this lawsuit, on 08/27/2013 i paid off a collection account from us bank that was for overdrafts ($1,317.01 ) when i figured out that they were puting the screw to me, i stopped using my account for a month then iput 35.00 in and left it alone, 3 months latter it was over 300.00 overdrawn i had plenty of words with them and nothing got done about it except the damaging of my credit when they finally sent it to collections. i wouuld really like to get my back,what can i do?

    I tried to pay back the overdraft and get my account closed and they would not work with me and told me that I had to come up with the money in full. I offered on many occasions even called the corp office and they declined me to make payments. they told me I would be charged 50 weekly until it was paid off. they would not stop the over draft or interest.

    i was charged overdraft fees because they sent out my bill pay payments before they where due to be sent an charged me overdraft fees becauce the money wasn’t in my account yet, an when i called the 800 number for the bank i was told that i was not due to have the overdraft fees removed from my account thus making me use my overdraft protection account an they then when a 100 dollar or more was deposited into my account they took out the money for my overdraft protection account plus the fee that that they chargered for me using my overdraft account. so i paid overdraft fees plus a fee depending on how much i took out of my overdraftprotection account. It was like if i took out $20.00 i paid that plus another $2.00. an that was how they got it, I was under the imprecion that they would automaticalytake the money fron my overdraft account so i wouldn’t have to pay the $35.00overdraft fee an that fee is charged to ever transaction you are over in your account. i have paid hundreds of dollars to them over the years.

    Referring to post number #3 located at the bottom of this webpage named Cansandra, how can you say that you already received $127.00 when the case has not even finalized yet? There is suppose to be another court date in December of 2013, so why are you saying you received a check? Not too mention how small that amount is in comparison to this 55 million settlement.     The last event that we had with US Bank, tried to cash a money order at the US Bank where I had an account. I even purchased the money order myself from a gas station. The teller told me she could not cash it, that I would have to deposit it. I asked her, if I could still use the funds from the money order that very same day, she replied yes that the funds would be available. So I went to the gas station to get gasoline and I find out later that US Bank did not make the money order readily available like they said and they began to bounce the account stating that the money order was not available on that day. That was just one of the many situations I had with US Bank.

    I guess I was late getting my card, and I am not sure if I have properly “signed up” …? HOLLY COW, I knew this was the case… every time I called or went into the bank to figure out why half of my paycheck was gone to overdraft fees (LITERALLY FOR MONTHS AND MONTHS, it was the cause of my financial flop AND the cause of a nasty family separation) … they were SO good at talking just enough crap to throw you off and somehow end the conversation without explaining and making you believe that it was your fault. Credit card and utility payments were be returned because you weren’t aware that they were scamming the money right from underneath you. OH, and the ridiculous fees they would asses when they sent you into overdraft and payments were rejected (with a fee) over and over and over… I wish I would have been wise enough back then to stand up and fight back, I should have known! THANK YOU, to everyone who stepped up and spoke out. I truly hope everyone who was effected by this gets it made up to them!

    I absolutely Loved the manager of the specific bank who set my account up as well as the tellers and professionals that still work at that one location but that’s as far as positive feelings go for the organization from the customer service (so called bank pros on the phones) to any of those stuck up bitches who will take a check of theirs from you, cash it for you then charge you for cashing their own bank check because you no longer have them as your financial institution. These people and this bank is only blocks away from my home but I will never stop there again, instead I travel 5.5 miles away from there to do business at any other US Bank when I have to cash any check of theirs.
    This bank took so much money from my account and LEGALLY found loopholes the fucking politicians created thanks to these lobbiests for the bank.
    US Bank and other banks as well are literally financially raping people in America who keep money there.
    $55M is shit compared to the amount they have STOLEN from each and every hard working American those fucking CROOKS!!!!!!!!!!!!

The are recently into robbing people again back dating transactions to create over drafts on your account. They are some slick bastards and the operators at the 1-800 # are rude and ruthless.     I have been being chrged $36.00 in OD charges for a long time. So yesterday I went in and click on the last amount which was in blue and it said I had a + amount and went to subtract the next transaction I was still in the +. But when I clicked on the blue colored balance amount a window popped up and said I was negative and the amount of the transaction that showed in the pop up box wasn’t the amount that was my transaction amount. I have always had issues with US BAnk and I am pissed. Yes they do try and explain but they make no sense just that I made a bad decision.

The amount any individual SCM will receive cannot be determined at this time.     i got that post card in the mail as well as many of you…. i requested more information and they sent out a small packet of the same vague information the card tells you…… tells you to do nothing to get your money. Seems kind of fishy to me. Sounds exactly like what a bank would send you to keep you from going to court and adding your name to who is owed and possibly increasing the money amount. The lawyers should be paid the amount they asked, but from the bank as court costs on top of the settlement, not part of it. that sounds like a scummy lawyer to me… it all seems fishy and i won’t believe any of it until i get a check that actually clears.

    What is the result of the court’s final decision on Dec. 18, 2013? My account with US Bank was consistently charged with overdraft fees. I always called the automated line to get my account balance which I was told would have the correct balance. So I would make purchases over the weekend and find out on Monday that I had been charged several overdraft fees. I would go into the branch and have to argue with the reps about the fees. I would be told that I was supposed to keep track of my transactions. I thought I was doing this by calling the automated line assuming all had gone through. So now I see what the bank was doing—-holding everything and allowing the transaction to go through instead of declining them so they could charge the overdraft fee. US bank owes me a lot of money!!!

If it were me that had used someone else’s money to fool people into believing that I was doing great things that would be just wrong.

    55 million is a drop in the bucket for them. Someone should be punished.

    I often wondered what happens to the remaining funds from these lawsuits. I know the law firms get a certain percent, cost and undefined help but who benefits from the rest? If we’re only going to get partial reimbursement it still does not compensate for the monies lost by the companies that did not receive their payments. Now we have bank overdrafts, companies unpaid, (that of course charge the customer for a returned payment), and the hell one goes through trying to get a reason for the charges. Now who is going to compensate customers for that? Who is going to revise the law on how much each party receives and a clear explanation as to how the “extra” money is allocated? $2.7 million people is not that large of a number provided that this is the total combining the banks involved. The statement of “plus” extra cost is not clarified so one will never get the precise amount of rewards granted to the people who fell victims to a well known bank scam. Who knows? (Shrugged my shoulder) in disbelief.

    Many banks still do this. They also hold deposits around here. I had a us bank account back in 2004 and went negative because they kept charging $180 in OD fees so I went to the branch manager and complained of course he didnt want to issue any credits and told them I would pay the one that made me go negative but not the rest because they had the transactions from largest to biggest and the excuse they gave me was that normally the highest transaction is the most important like a utility bill, car payment, rent, etc.. And the consumer would want that paid. I told the manager to close the account because I wasn’t going to pay them fees. Anyways the account was not closed and us bank sold the debt to god knows how many collectors. I also told them the debt was not valid and wasn’t going to pay them and explained why. Of course they give you crap about how your making an excuse which is crap. 6 years later my mother gets a call from a collection company claiming the debt was a lot more than what the bank left it at and if it wasn’t going to get paid then I would go to jail. They have searched for all my relatives searching for me and telling them this crap! Of course my mom falls for it and pays these people without me knowing. Of course another person calls and saying I owe them for this us bank account a year later but I sent them a recepit where this non valid debt that got paid anyways was paid! But as of yesterday (worldwide solutions) almost a decade later I still got people calling relatives and harassing me. I’ve had my number changed and on the do not call list and done everything because apparently the fair credit practice act is a bunch of bs! but the one thing I can say now is STAY FAR AWAY FROM US BANk and Bank of America cause they do the same crap but luckily I got rid of that account because they wanted to charge me a monthly maintance fee after being with them for almost 8 years. Yet they still haven’t charged my husband but yet the bank tells me its everyone! They all feed you crap just to save their asses.

    For many years I banked at U.S. Bank. I opened a savings account with them when I was under 18, and had my parents as a co-signer on the account. Even many of my relatives did, and still do conduct business with them. My Grand-Father was one of their first customers in this area, and that was over 50 years ago.
    Unfortunately, since then, they have lost sight of business ethics. Treating customers as cash crops by charging them unwarranted overdrafts is a big way to loose customer loyalty. I did not choose to close my account at U.S. Bank, it was charged off due to over $800 in overdraft fees. At the time, I remember making payments at their local branch, and for some reason, it would never get posted.
    Eventually, shortly after they charged off my account, I was contacted by the branch manager of where I normally conducted banking transactions. Upon entering the bank, and sitting down to talk with the branch manager, I was informed that if it was not paid off within a certain time limit, other problems would arise. The main problem being them contacting the local authorities, and pressing charges to gain a warrant for my arrest. I was unemployed at the time, and they did not care.
    So, I had to borrow money from my relatives to pay off the overdraft. Since then, the person that helped me has passed away. With every incident of an overdraft charge through a bank, an individuals personal credit is damaged. Due to their practices, my credit was so damaged that by the age of 24, I could not gain a loan even with a co-signer that has what is considered a gold credit score.
    Shortly after paying off their bogus trumped up overdraft charges, I went to another bank. Through total irony, that bank was also recently sued for $15 million for the exact same thing. Guess what happened, the bank lost, and was forced to pay. Granted, they paid me all of the excess amount of what I had paid them in overdrafts but, U.S. Bank needs to be required to pay back every penny they illegally took from customers via misappropriation of overdraft fees.
    That probably will never happen due to how messed up our legal system is. What really needs to happen is, restitution of the total amount of fees taken from customers to be paid back in full to the very penny, and the person who came up with the transaction posting system arrested, and place in jail. However, chances are that will never happen. If it was one of us private individuals, we would be put in jail so fast it would make your mind spin in amazement. For high powered executives who think they can do whatever they want, all they get is a minor slap on the wrist.

They will automatic deposit to your account if you’re still with US bank. If not they will mail a check to you so make sure the bank has your current address if you’re no longer a customer.

      They did the same thing to me! US Bank blamed the merchants not posting the debits/charges. Made THEM out to be the bad guy. US Bank also posted the higher item in my case, too. Funny but I had some issues at Bank of America but never did they blame merchants or charge me overdraft fees when they screwed up. They were sued a while ago as well, but I think they learned their lesson. US Bank is bold!! They’ve got a lot of nerve continuing their deceptive practices!

    News flash~ US Bank is STILL at it! Everything that they’ve been guilty of that is listed in this class action lawsuit they’ve done to me this month!! I filed a new complaint but your records show that I haven’t filed one yet. US Bank must be recovering their losses by screwing over their new account holders like myself! They’ve posted items NOT in the order the charges were made, withheld funds in my account causing 2 items to not clear, which caused an overdraft fee x3 ($35 ea.). To add insult to injury they tacked on 2 (so far) $25 fees because I am still overdrawn THANKS TO THEM!! I am furious!!! Deceptive, low-life, sneaky, greedy SOBs!! The teller at my local branch refused to look at my checkbook to see the order in which my charges were made, but still dug in her heels insisting the OD charges were legit! I know it’s too late to be part of this latest class action lawsuit against US Bank, but please consider me if a new one if filed. Thanks so much!

    I called the number from the website and they gave me an email address to write to so I did and just got a response. They confirmed that I was, in fact, included in the settlement and then went on to reiterate the order of all the appeals and such and that as of right now they have not gotten any finalization on the last appeal. On June 24, 2014, the Court issued an Order dismissing the appeal, and the Effective Date is therefore July 1, 2014. We do not yet have a specific date available for when account credits will be applied in instances of open accounts, or when checks will be mailed for former accounts. We appreciate your patience as we work to distribute funds in advance of the October 29, 2014 Court deadline. This site will continue to be updated as specific dates and details become available.
