Many manufacturers of stress urinary incontinence treatments are considering settling a number of lawsuits alleging the devices are faulty, and one company has decided to set aside millions of dollars for Coloplast vaginal mesh implant settlements.
The $16 million set aside by the Danish medical device maker would cover the costs of settling 400 vaginal mesh lawsuits, which had been centralized in U.S. District Court for the Southern District of West Virginia. It would result in cash payments of roughly $40,000 for each of the women, according to a Bloomberg report.
It comes at a time when many manufacturers are considering ending litigation in that manner after, although not stated specifically because of, jury awards in trials that could cost makers millions. One woman who suffered from vaginal mesh implant side effects was awarded more than $3 million in compensatory damages in a New Jersey state court against Ethicon.
In spite of the efforts resulting in Coloplast vaginal mesh implant settlements, there are still thousands of pending cases in West Virginia against makers including Ethicon, but also Mentor Worldwide, C.R. Bard and American Medical Systems, among others.
C.R. Bard agreed to settle more than 500 vaginal mesh lawsuits filed against the medical device maker in early August. There are still about 12,000 vaginal mesh lawsuits pending. However, the amount of settlement has not yet been disclosed.
Each of the complaints share common questions: whether or not the companies knew that using synthetic mesh made of polypropylene would lead to inflammation around the bladder and pelvis, leading to device dislodgement, organ scarring and other issues. For some women, not only did the stress urinary incontinence treatments lead to these adverse events, but in many cases did not treat the original problem.
In general, transvaginal mesh lawsuits are filed individually by each plaintiff and are not class actions.
