Red bull class action lawsuit is filed.A federal class action lawsuit wants Red Bull North America to stop sending unsolicited text messages to customers’ cellphones, and to pay damages for each unwanted text it sent.

The class action lawsuit claims Red Bull is violating the federal Telephone Consumer Protection Act (TCPA), which prohibits companies from not only using an “automated telephone dialing system” to contact consumers, but also from contacting consumers without their express prior consent. The Plaintiff claims that neither she nor other members of the proposed Class ever consented to having Red Bull send text messages to their phones.

The Plaintiff claims she received several unsolicited text messages from Red Bull, but that neither text provided an opportunity to opt-out of receiving future messages.

“By sending those text messages, [Red Bull] caused Plaintiff and the members of the Class actual harm, including the aggravation and nuisance that necessarily accompanies the receipt of unsolicited text messages, and the monies paid to their wireless carriers for the receipt of such messages,” the class action lawsuit states.

The Red Bull text class action lawsuit is brought on behalf of all individuals in the U.S. who received a text message on their cellular phone sent by or on behalf of Red Bull. It is seeking actual and statutory damages, an injunction requiring Red Bull to cease all unsolicited text message activities, attorneys’ fees, court costs, and more.

The case is Thi Thieu Miller v. Red Bull North America, Inc., Case No. 12-cv-04961, U.S. District Court, Northern District of Illinois, Eastern Division.
