Procera AVHA federal court has preliminarily approved a class action lawsuit settlement that will provide a $20 cash payment or 50%-off savings voucher to consumers who purchased Procera AVH, which the Plaintiffs allege was falsely advertised as helping to improve brain function.

The Procera AVH settlement will resolve a class action lawsuit, entitled O’Brien, et al. v. Brain Research Labs, LLC, that alleges Brain Research Labs (“BRL”) made false and misleading advertising and marketing statements that Procera AVH improves brain function. BRL sold Procera AVH primarily through direct marketing channels (such as infomercials and on its website), but also at select retail establishments.

BRL denies any wrongdoing, but has agreed to a class action lawsuit settlement to avoid ongoing litigation.
Class Members of the Procera AVH class action settlement include all U.S. residents who purchased Procera AVH from January 1, 2005 to March 23, 2012 through direct marketing channels or through retail. Purchasers who have received a refund or debit/credit card chargeback for the purchase price of the product at any time are NOT included in the class action settlement.

As a Class Member, you’re entitled to one of the following benefits if you submit a valid claim form postmarked or submitted online at www.gilardi.com/brlsettlement by August 10, 2012:

  • 50%-Off Savings Voucher: Each Settlement Class Member can choose to receive a savings voucher for 50% off the purchase of any of the following BRL products: Procera AVH, Ceraplex, Omega-3 DHA, Gabarest or 20/20 BrainPower Book. Each of these products has an MSRP of between $19.95 and $69.95 per unit.
  • $20 Cash Payment: In lieu of the savings voucher, Settlement Class Members can choose to receive a one-time cash payment of $20. This amount may be reduced pro rata if the amount of valid claims submitted requesting a cash payment exceeds $500,000.

    Read Grain Brain…….as a nation many people do not exercise the way we did in the 50s and before. Our forefathers didn’t take this pill. They exercised their minds with the written word. Physical Education isn’t even a class in schools anymore. Junk food and sugary drinks are offered in schools – junk food and drink machines are in schools nowadays. The most important things we can do for our brains is the same thing we should do with our bodies…exercise. As a nurse who HAS done the research, this pill is a placebo regardless of what is in it.

    LOL. I think it’s really funny that most of the people posting on here have never taken Procera. I have taken it off and on for many years and there is a profound difference in my memory and my ability to concentrate while on it. I have never had any side effects. Lot’s of fear mongering here and in our litigious society. Do your own research.

    I can’t believe how many gullible people we have in this country. When will people learn you can’t get good health, mental or physical, from a damn pill bottle!? Most “brain fog” and other ailments many people suffer from are actually CAUSED BY pills. Throw away the pills and read books, exercise, eat nutritious foods, and remove the clutter and stress from your life if you want to feel better.

      Apparently is you didn’t look at it it isn’t a drug pill it is a nutritional supplement that encourages you to exercise and eat nutrious foods but seeing how you’ve never given the product a try it would be pretty ignorant of you to tell him his results are all in his head and i’d question you have any idea what youre talking about.

    Mekalbo, your “improvement” is all in your mind. (no pun intended) You’re throwing your money in the toilet. I don’t care what they say on their scripted infomercial, it’s bullsh**.

    I have been taking Procera AVH for almost 2 years now. I can feel the improvement in my memory and alertness almost 80%.

    As with all lawsuits, the infomercials can still do their ads. I would like to think there really is a pill that can help, but not so sure I want to try this from a site that appears so much on the scam side. But you also know pharmicudical companies will not do well or so as health clinics, hospitals, if a cure is made, then we will have folks out of work, , so sites such as this infomercial can go on forever and prey on folks who will do anything and pay, even if it might harm them. You get one site, another one pops up, so folks, before you buy, always do your homework, look it up, keep searching around til it seems like it really might be a legitimate site, and or you talk to your doc and or herbalist to help you out,and or your pharmists. (my spelling is horrible, sorry)
