Best Buy Mobile Phone Protection Plan Class Action Lawsuit

Best BuyAn unhappy customer has filed a class action lawsuit against Best Buy claiming it promises to give customers who buy a mobile phone protection plan a new phone if their cell phone breaks, but actually gives them a refurbished phone.
 
Plaintiff Debra Wanless alleges in the class action lawsuit that she signed up for the Geek Squad Black Tie Protection plan, which promises to furnish a new phone if the old phone is damaged beyond repair, including if the damage is caused by an accident.
 
Wanless claims she bought an iPhone 4 from Best Buy because of this protection plan, which cost her $14.99 a month for 2 years. Wanless says a Best Buy employee told her the plan was “the best insurance one could buy for a mobile phone” and that all she needed to do was bring in the broken phone and Best Buy would hand her a new phone.
 
But that’s not exactly how it worked out, she says.
 
Wanless claims in the class action lawsuit that when she accidentally dropped her iPhone and shattered its case, she brought it to a Best Buy store and was told for the first time that she would get a refurbished phone. When she complained, an employee allegedly told her that refurbished phones are “basically new phones,” but could not tell her if the refurbished phone she would be getting had any previous problems, according to the class action lawsuit.
 
Wanless says she spent $254 for Best Buy’s mobile phone insurance plan before having to use it, and says had she known at the time of purchasing the plan that she would only ever get a refurbished phone instead of a new one, she would never have paid so much for the Best Buy Mobile Phone Plan or bought it in the first place.
 
Wanless is seeking damages for California residents who bought protection plans from Best Buy within the past four years, alleging unfair competition, deceptive advertising, breach of warranty, bad faith and unjust enrichment.

    Quiero comentar algo que me pasó a mi yo compre una lap top para mi hija me costó 1,100 dólares al parecer mi hija me dijo q no agarraba wifi la yebo ala tienda y me dicen q no pueden hacer nada que por q son otros problemas solo tengo 6 meces con la computadora y de verdad siento una injusticia a que uno con tanto esfuerzo y trabajo les compramos sus cosas a nuestros hijos para q en 6 meces se descomponga y no agan absolutamente nada y solo digan q ellos no pueden hacer nada yo compre la computadora en Best Buy Gainesville ga

    When I got three phones through best buy mobile I purchased two warranty protection plans on two iPhones it costed me 575 out of pocket I used it twice in one phone not in the other one I wanted my money back they refused me money that I paid out of my own pocket they said I’m only allowed store credit Store credit with my own money I used for these phone’s really , I go to renew my contract I asked again they told me if I came back before my other contract was over id be getting my money back , I said I did they refused do you know they got too keep my money I wasn’t making payments I paid it in full

    Same story as everyone else. Best Buy employees ripped me off. I havent even had the phone a year and the port cover broke. I took it into Best Buy as instructed and they said nothing they could do and the terms of the contract changed. Said I would have to pay $150.00 and then 100.00 to get refurbished phone. Horrible

    I have similar situation that Best Buy had wrong promising regarding its insurance / warranty plan. I brought the phone to repair which it still under manufacture warranty coverage and it gave me back a used refurbished crapy phone. I requested to get my old phone back that I could send to manufacture for replacement and it just simply simply replied my old phone could not be located. Best Buy is a theft. It probably send my phone to manufacture to claim a new phone.

    I was also sold this crap insurance for 2 yrs and when I had a problem they wanted to give me a refurbished phone that is after I had to keep a cheap phone for 3-5 weeks while I received a refurbished . I ended up cancell ing my insurance and had to buy a NEW I Phone on my own..never will I carry insurance again waste of money

    Wish I could file against this. not only gave me 3 crappy refurb phone but took money out of my account for the wrong person for 2 years and will not refund. i cancelled my services geek squad and best buy are a joke. not a customer anymore.
