Mirena IUD birth controlA recently filed Mirena IUD birth control lawsuit accuses Bayer of concealing the increased risk of complications allegedly caused by Mirena, including perforation, migration, embedment, ectopic pregnancy, intrauterine pregnancy, cancer, adhesions, cysts, fetal injury, fetal death, early/premature menopause, and other permanent injuries.

Mirena is a popular intrauterine device (IUD) used by millions of women around the globe. Somewhat similar to the copper-T IUD, Mirena is good for five years and is implanted into the uterus where it releases a small amount of hormones. Bayer, the maker of Mirena, has already been under fire with government agencies for under-warning about risks and over-promoting the benefits of Mirena in the Simple Style Program, which claimed that the IUD improved a woman’s romantic life.

However, the emergence of hundreds of Mirena IUD lawsuits comes with allegations that there are bigger risks when using the birth control device than what Bayer claims or warned about. One such Mirena lawsuit filed by Missouri plaintiff Celeste Howser exemplifies the typical complaints raised against Bayer over the controversial birth control.

Howser claims that “when warning of safety and risks of Mirena, Defendant negligently and/or fraudulently represented to the medical and healthcare community, the Food and Drug Administration (hereinafter referred to as “FDA”), to Plaintiff and the public in general, that Mirena had been tested and was found to be safe and/or effective for its indicated use.”

According to her Mirena lawsuit, “defendant concealed their knowledge of Mirena’s defects, from Plaintiff, the FDA, the public in general and/or the medical community specifically. These representations were made by Defendant with the intent of defrauding and deceiving Plaintiff, the public in general, and the medical and healthcare community in particular, and were made with the intent of inducing the public in general, and the medical community in particular, to recommend, implant and/or purchase Mirena for use as a contraceptive, all of which evinced a callous, reckless, willful, depraved indifference to health, safety and welfare of the Plaintiff herein.”

There were always warnings on the labels that Mirena could migrate or perforate organs/tissue during insertion, but they never mentioned that IUD migration could occur weeks, months or even years later, lawsuits claim.

Furthermore, Howser states that “defendant negligently and improperly failed to perform sufficient tests, if any, on women using Mirena during clinical trials, forcing Plaintiff, and her physicians, hospitals, and/or the FDA, to rely on safety information that applies to other contraceptives, which does not entirely and/or necessarily apply to the Mirena whatsoever.”

Neither her doctor nor herself were warned of the full Mirena side effects, the lawsuit claims.

“Defendant was negligent in failing to adhere to and/or take into consideration warnings from the FDA, who determined that the Defendant was misleading the public in general, and the medical community in particular, through the use of advertisements which overstated the efficacy of Mirena and minimized the serious risks of the product,” the Mirena lawsuit states.

“As a result of the defective nature of Mirena, those persons who use and/or used and relied on Mirena have suffered and/or are at a greatly increased risk of serious and dangerous side effects including, including, inter alia, perforation, migration, embedment, ectopic pregnancy, intrauterine pregnancy, cancer, adhesions, cysts, fetal injury, fetal death, early/premature menopause as well as other severe and personal injuries which are permanent and lasting in nature, physical pain and mental anguish, including diminished enjoyment of life and a future of high risk pregnancies and infertility, as well as the need for lifelong medical treatment, monitoring and/or medications, and fear of developing any of the above named health consequences.”

Howser says that Bayer had plenty of opportunity to update their warnings. “Defendant has failed to alter their product packaging to reflect the growing number of MedWatch Adverse Event reports related to embedment of and perforation through the uterine lining and/or migration of the IUD through the uterine lining after the period of insertion. Defendant has a history of overstating the efficacy of Mirena while understating the potential safety concerns.”

The Mirean IUD lawsuit is Celeste Howser v. Bayer Healthcare Pharmaceuticals Inc., Case No.: 2:13-cv-06143-SDW-MCA, in the United States District Court District of New Jersey.

    I’m a 22 year old woman. I have a 6 year old child and got the mirena IUD shortly after her birth . I wasn’t told about how it worked , side effects etc. It was just kind of pushed on me with no knowledge. After it was inserted I bled for 16 weeks non stop. I was told this was normal? Which I later found out was definitely 100% not! But as a 16 year old I didn’t know very much. After the bleeding stopped I never had another period for the 4 and a half years it was there. I had a lot of pelvic pain and after numerous tests was told I had ovarian cysts most likely from the coil. I was advised to continue using the mirena and the cysts would gradually go away on their own. Afterwards with more trouble I finally got it removed last year as myself and partner decided to try for another child. I was told by my doctor that my fertility would return to normal almost immediately. It did not . to make a long story short after failing to get pregnant after almost a year we decided to get checked over. Both healthy non smokers non drinkers healthy eaters etc my partner was told he was perfectly normal. Me on the other hand… After numerous tests and numerous diagnosis that went from ” polycystic ovaries , endometriosis , hormone imbalance ” etc I finally got told the news I knew deep down already. I was no longer able to have children. The mirena had imbedded hence y I had it removed but because of that it left a lot of scar tissue , along with the cysts it had made form.Do not get this!

    I got the marina iud in 2008 I had every side effect from bleeding non stop for 16 weeks start to mood swings but the one side effect that has left me scared and emotional depressed is the acne!!! Yes never having any to enduring this horrible thing in left now with ugly scars covering my face;;; I have seen Dr that will laser them but my poor skin is so thin it could cause more harm or
