claims-unum-rejectedAn Indiana woman filed a bad faith insurance lawsuit against Unum Life Insurance Co. alleging the company wrongfully denied her claim for long-term disability benefits.

Plaintiff Sherrie H. worked full-time at Community Health Network until January 2013 when she became disabled, according to her Unum lawsuit. As a benefit of her employment she received short- and long-term disability insurance from Unum.

The disability insurance lawsuit was not specific about what problem she suffered from that led her to file the long-term disability claim. However, it says  “she was forced to cease working.”

She followed the procedures to receive the benefits, according to the lawsuit, but was still rejected by Unum.

Like many others who have filed claim denial lawsuits against Unum for rejecting their claims, Sherrie said she submitted all the paperwork she was required to, including medical documentation. Unun’s denial, the lawsuit says, was for no good reason.

“The Defendant’s decision was not based upon substantial evidence or the result of a principled and reasoned decision-making process,” the lawsuit says. “Instead, the Defendant’s decision was reached by Defendant ignoring relevant evidence pertaining to Plaintiff’s claim and, instead, relying upon biased information and flawed expert opinions.”

After the claim was denied, Sherrie followed the proper procedures to appeal the rejection, the lawsuit says. Because Unum is in charge of reviewing the appeal and would benefit financially by not having to pay out a claim it has a conflict of interest.

Unum has frequently been criticized for ignoring medical advice and using its own questionable “experts” to deny what have been reported to be legitimate claims.

Because she cannot work and was denied her benefits, Sherrie’s lawsuit seeks back payment of the benefits, as well as payment of her lawyer’s fees.

The Unum Lawsuit is Case No. 6:15-cv-03742-GRA, in the U.S. District Court of South Carolina, Greenville Division.
