The latest testosterone drug lawsuit, filed in Illinois federal court, alleges that Eli Lilly failed to warn the medical community and general public about dangerous side effects associated with using testosterone replacement therapy.

Plaintiff Yennyfer B. brought the testosterone lawsuit individually and on behalf of the now deceased David B. Yennyfer is the surviving heir of David B., who was prescribed and began using a testosterone replacement therapy known as Axiron in September of 2012. David stopped used the medication a little over a year later.

According to the testosterone replacement therapy lawsuit, using the medication caused David to suffer from a serious heart attack. David died on Oct. 9, 2013. The testosterone lawsuit brings claims of strict products liability, design defect, negligence, negligent misrepresentation, breach of implied warranty, fraud and punitive damages.

Yennyfer brought the testosterone lawsuit as part of the multidistrict litigation, or MDL, moving through the judicial system. Multidistrict litigation is a tool to create consistency and efficiency among cases that share similar facts and similar issues of law. The testosterone lawsuits are being funneled before a single judge, the honorable Matthew F. Kennelly, and will remain before a single judge while discovery and pretrial motions are made.

Once that stage of litigation is complete, many of the lawsuits that have not been settled will return to their court of original jurisdiction, or the place where the lawsuit would have been originally filed had it not been for the multidistrict litigation. David was a resident of Columbia County, Georgia, so Yennyfer’s testosterone replacement therapy lawsuit will return to the U.S. District Court for the Southern District of Georgia when the time comes.

Testosterone Replacement Therapy Lawsuits

Several testosterone lawsuits have been filed across the nation. According to the lawsuits, advertising campaigns for Low-T treatments have caused many men to begin taking testosterone replacement therapy drugs for a condition they do not actually have.
