Ritz-Carlton Hotel Package Class Action Lawsuit

Lead Plaintiff Christian McCue alleges in the Ritz-Carlton class action lawsuit that he and his wife purchased a “Discover With You” weekend package through the Ritz-Carlton website that explicitly stated included “Full American Breakfast for two in Cioppino per day, the Resort’s signature restaurant (Includes gratuities and taxes).” However, at the end of their stay, McCue and his wife were charged $33.66 for gratuities and/or taxes for two breakfasts for two at Cioppino.
After questioning the charges, McCue says the Ritz-Carlton responded: “The guest is responsible for taxes. He was given the credit on the meals for the breakfast… No adjustment need to be done.”
This constitutes breach of contract and violation of Florida’s Deceptive and Unfair Trade Practices Act, the class action lawsuit states.
The Ritz-Carlton class action lawsuit is brought on behalf of all persons who have purchased packages from Ritz-Carlton that include breakfast, which included the cost of breakfast, gratuities and taxes. It is seeking actual damages for violation of the FDUTPA, monetary damages, attorneys’ fees and an injunction barring the Ritz-Carlton from future violations.
