Sprint surcharges class action settlementOn Friday, plaintiffs asked a Georgia federal judge to give final approval to a $3.4 million class action settlement that would resolve allegations that Sprint Communications Co. LP charged customers hidden fees.

In October, U.S. District Judge Clay D. Land preliminarily approved the Sprint surcharge class action settlement and certified the settlement class. A final approval hearing for the Sprint surcharge settlement has been scheduled for April 10, 2014.

If approved, the Sprint surcharge settlement would resolve a class action lawsuit that was filed back in April 2009 and accused Sprint of imposing surcharges that were not authorized by customers’ wireless service contracts. The plaintiffs alleged Sprint improperly disclosed certain monthly surcharges that it imposed to defray certain costs such as those associated with government programs and network connections.

“The litigation was hard fought; the parties engaged in significant motion practice and discovery,” the plaintiffs said in their motion supporting final approval of the Sprint fee class action settlement. “The case involves sharply opposed positions on several fundamental legal issues. The parties arrived at a settlement only after vigorous arms-length negotiations conducted by experienced counsel under the supervision of two mediators.”

Under the terms of the proposed Sprint class action settlement, an estimated 2.3 million Sprint customers would be eligible for a $1 rebate or non-cash benefits. Sprint also agreed to revise its contracts to ensure that customers will be fully informed about the type and amount of Sprint surcharges and any contract changes in the future.

Class Members of the Sprint surcharge settlement include all individuals in the United States who held a contract for wireless services with Sprint between Jan. 1, 2007 and Oct. 8, 2013 and were subject to Sprint surcharges on any wireless lines of service. A sub-class of individuals who were subject to Sprint surcharges without receiving notice of the surcharges has also been certified.

Cash benefits for the class action settlement include a $1 account credit for current Sprint customers or a $1 check, electronic transfer or e-account credit to former customers whose accounts are not past due. Non-cash benefits include a 30-minute long-distance calling card, a 30 percent discount on any one accessory purchased at a Sprint-owned retail store, or a waiver of the $36 activation fee when activating a new line of service. Class Members will have the option to choose either the cash or non-cash benefits when they submit their Claim Form.

The plaintiffs are represented by E. Adam Webb and Matthew C. Klase of Webb Klase & Lemond LLC.

I get the surcharge but what about the stores with the sprint logo and you go in and get a new phone thinking it’s a sprint store. Then when they mess up your bill and what was supposed to be cheaper is now 100s more per month. They are charging you for 2 plans half of your phones on one and the other on a completely different one. I wish I could say this only happened once. Also because they are kiosks. They are not wolllung to do much about it. If u go in the store they make you call online. 13 hours on the phone… 3 hours in the store.. and then it happened a again when my son needed a new phone. Then again when we changed phones the next time. Over 15 years with these crooks. Need to switch but the fees for that oye! The latest crooked act was changing my plan that expired to whatever they wanted and adding in hotspot increasing my bill without so much as a phone call. Then I have to take more time out of my day to call again and let them start the process of how many employees does it take to get into your account and make changes and how many phone calls til they get it resolved.

  7. Joyce Terry says:

This is a really BAD joke, right? Why are we being offered one lousy dollar for years of Sprint’s abusive and dubious charges? A more reasonable about would $5 per month multiplied by the number of months one had Sprint service…higher for Family Plans plus all reasonable legal Fees.
