Readers of Top Class Actions are reporting that they are receiving checks worth between $8 and $15 from the Horizon Organic/Silk Milk class action settlement.
The class action settlement, which was reached in 2013, provides refunds to consumers who purchased Silk Soymilk, Silk Coconutmilk, or Horizon Organic milk, yogurt or Tuberz products between 2005 and 2013.
The Horizon/Silk settlement resolves a class action lawsuit (Singer v. WWF Operating Company d/b/a WhiteWave Foods) that alleges the Horizon and Silk products were falsely marketed because they listed “evaporated cane juice” in the ingredients instead of “sugar.” According to the plaintiffs, the products are mislabeled because evaporated cane juice is not actually juice and therefore misleads consumers into believing it is healthier than products that include “sugar” as an ingredient.
WhiteWave Foods denies violating any laws but agreed to settle the class action lawsuit and provide refunds to consumers in order to avoid the expense and uncertainty of ongoing litigation.
Class Members of the Silk/Horizon Organic Milk settlement include anyone who purchased the following products for personal use between Jan. 1, 2005 and April 19, 2013:
- Horizon Organic Lowfat Chocolate Milk plus DHA Omega-3
- Horizon Strawberry Lemonade Squeeze Tuberz
- Horizon Surfin’ Strawberry Tuberz
- Horizon Sour Apple Spray Tuberz
- Horizon Blueberry Wave Tuberz
- Horizon Lowfat Strawberry Milk Box
- Horizon Lowfat Vanilla Milk Box
- Silk Organic Original Soymilk
- Silk Organic Vanilla Soymilk
- Silk Pure Coconut Original Coconutmilk
- Silk Horizon Fat Free Vanilla Yogurt
Under the terms of the class action settlement, Class Members who provided valid proof of purchase when submitting their claims were eligible for reimbursement of 75 percent of the purchase price, up to a cap of $50 per household. Claimants without proof of purchase were eligible to receive a refund of 25 percent of the purchase price of up to five products.
The deadline to file a claim for the class action settlement passed on Oct. 26, 2013.

I filled out the form for this class action, and I have not got any check as of yet. This is like the 3 Rd time that I have filled out Clas action forms ,and have not received any payment.
My check was $9.89 (California). Better than nothing I guess.
