Honda Civic class action lawsuitUPDATE 2: A claims filing deadline has been set. Class Members have until April 19, 2013 to file a claim.

UPDATE 1: The Court approved the Honda Civic Hybrid settlement on March 16, 2012. An appeal has been filed, which will delay the Effective Date. Once (and if) the final appeal is resolved, an Effective Date will be set and distribution of settlement benefits will begin. A Superior Court Judge has approved a class action lawsuit settlement with Honda that resolves claims it falsely advertised the estimated fuel economy of its 2003-2009 Honda Civic Hybrids. As a result, Honda Hybrid owners can file a claim to receive a $100 cash payment and several other benefits from the Honda Civic Hybrid settlement.

The Honda Civic Hybrid settlement will resolve a 2010 class action lawsuit alleging that the fuel economy estimates Honda advertised for the Honda Civic Hybrid could not be achieved under normal driving conditions. The class action lawsuit also claimed a July 2010 Honda software update to the Integrated Motor Assist (IMA) battery system negatively impacted the fuel economy and performance of its 2006, 2007 and 2008 Civic Hybrids.

Honda denies the allegations but has agreed to a class action lawsuit settlement to resolve the litigation.Class Members of the Honda Civic Hybrid class action settlement include anyone in the United States and/or District of Columbia who purchased or leased a 2003 through 2009 Honda Civic Hybrid, other than for the purpose of resale or distribution.

The class action settlement also includes a subclass of anyone who purchased or leased, other than for resale or distribution, a Honda Civic Hybrid model year 2006, 2007 or 2008.

If the Court approves the Honda Civic Hybrid class action settlement at the March 16, 2012 Final Fairness Hearing, If all appeals are resolved, Class Members can file a claim to receive the following benefits:

(1)  Cash Payments. If you are dissatisfied with the fuel economy you have achieved in your Honda Civic Hybrid, you can receive a cash payment of $100. If you are a Subclass Member and are dissatisfied the performance of your vehicle’s hybrid battery or the July 2010 Software Update, you can receive an additional $100.

(2) Rebate Certificates. In addition to the cash payment, all Settlement Class Members will be entitled to request a rebate certificate entitling them to either a $1,000  non-transferable rebate on the purchase or lease of a new Honda or Acura vehicle, or a $500 fully transferable rebate. Subclass Members can receive an additional $500 fully transferable rebate certificate.

Class Members of the Honda Civic Hybrid settlement can also receive an IMA Warranty Extension or a Fuel Economy Video describing ways to maximize and optimize vehicle fuel economy.

To receive any of these settlement benefits, you must submit a claim form six months from the Effective Date. The claim form deadline will be no sooner than October 15, 2012, but may be later. Once the Effective Date is known, it will be posted on www.HCHSettlement.com.

The deadline to file a claim for the Honda Civic Hybrid settlement is April 19, 2013.

    Only 33-34 mpg very dissatified! Very disappointed as reg. civic got that kind of mpg.

    I am dissatisfied with the fuel economy of my 2003 Honda Civic Hybrid, it only gets 33/34 mpg. New issues are have now developed with the battery and starter clutch. The IMA dashboard light is now on. At a cost of $2000 to repair, it may not be practical for me to invest in these repairs. Do I qualify for the battery settlement even though repairs have not been made yet?
