Viewers of Top Class Actions are reporting on our Facebook page that they have received checks in the mail from a class action settlement over allegations Vivint Inc. violated the Telephone Consumer Protection Act (TCPA) while promoting Vivint home alarms and services.
The TCPA class action lawsuit alleged Vivint violated federal law by using prerecorded messages and autodialing systems to contact consumers and businesses throughout the United States. Viewers have reported receiving checks worth $69.51 from the Vivint class action settlement.
The Vivint TCPA settlement resolves allegations that Vivint’s telemarketers violated the TCPA by utilizing autodialing equipment and prerecorded messages to contact persons and entities throughout the country since 2008. The class action lawsuit also accused Vivint of placing calls to consumers who had registered for the National Do Not Call Registry and on Vivint’s internal Do Not Call list.
Vivint denies the allegations, but agreed to pay $6 million to settle the class action lawsuit. By agreeing to the TCPA settlement, Vivint was able to resolve the litigation without the burden and expense of trial.
Class Members of the Vivint TCPA settlement include all individuals and entities in the United States that received one or more “Covered Calls” on behalf of Vivint on or after Sept. 17, 2008. According to the settlement documents, “Covered Calls” mean either a call utilizing an artificial or prerecorded message; a call made through the use of automated dialing equipment; or a call made to a telephone number that was registered on the National Do Not Call Registry or on Vivint’s internal Do Not Call list.
Under the terms of the Vivint TCPA class action settlement, Class Members were eligible to receive up to $500, but the actual amount distributed was reduced pro rata due to the number of valid claims that were filed.
The deadline to file a claim for the Vivint TCPA class action settlement passed on July 28, 2014.
