Young woman sues Bayer after her Mirena IUD migrated and perforated nearby organs.

Washington plaintiff Kaci Lewis is suing Bayer Pharmaceuticals for the injuries she allegedly sustained from their Mirena IUD birth control product.  Lewis alleges that she suffered serious injuries and had to undergo invasive surgery as a direct result of using the device.

Lewis first had the Mirena IUD inserted into her on June 23, 2012, and reported no initial complication during and after the insertion was complete.  However, less than a month later, the plaintiff visited her doctor for abdominal pain.  Upon the medical examination, her physician discovered that the IUD was no longer inside her uterus.  X-rays revealed that the Mirena IUD had migrated to somewhere else inside the plaintiff’s pelvis.

On July 25, 2012, the plaintiff underwent surgery to have the IUD removed, which had been discovered to have embedded itself in her omentum, or abdominal wall.  The plaintiff is still recovering from the surgery, and may have incurred undiscovered injuries that have yet to present themselves. Additionally, this had caused the plaintiff to lose time at work, while incurred massive medical costs.

At no point in time did Lewis or her physician were aware of the possible occurrence of migration, as it was described as an uncommon event on the product’s label.  The defendant company made no effort to notify the plaintiff, nor made her physician aware of any relevant studies.  Lewis states that Bayer had the responsibility to warn her of any adverse side effects, because she was relying on the given information.  Lewis states that if she had known about the possibility of migration, then she would have never have used the device.

So for being directly responsible for manufacturing, selling, distributing, and marketing a dangerous product, Lewis is suing Bayer Pharmaceuticals.  The charges include: negligence, false advertising, misrepresenting a product, and concealing information.

Overview of Mirena IUD Complications

The FDA first approved the Mirena IUD in December 2000, and has been prescribed to millions of people since its release.  According to medical statistics, Intrauterine devices are the most popular choice of contraception for women in the United States.  The Mirena IUD is the most commonly prescribed, totaling 15 million users worldwide.  It is manufactured by Bayer Pharmaceuticals, and has been thought to be one of the safest and most convenient methods of birth control, until recently.  Despite the large convenience the device provides to patients, there have been numerous reports of IUD migration and embedment, such as Lewis had suffered.

The IUD itself is a small and t-shaped, made from a biologically safe plastic, which is directly inserted into the uterus.  The device’s endpoints contain a synthetic progestin called levonorgestrel; the hormone directly counteracts ovulation and sperm-to-egg fertilization.  It is a long-lasting device, designed to last up to five years, which has earned mass praise from the medical community and patients alike.  However, as mentioned earlier, reports of device migration and embedment have been reported numerous times throughout the years, with some resulting in more serious injuries such as non-cancerous cysts and ectopic pregnancies.

Lewis’ case will be joining a multidistrict litigation (MDL) centered in western Washington, where she will stand alongside other plaintiffs who suffered similar injuries.  This case is still pending.
