Nexium class action settlementLitigation surrounding the alleged delayal of less expensive generic versions of Nexium (esomeprazole magnesium) by several pharmaceutical companies continues to progress in federal court. If the parties are unable to reach a class action settlement, the Nexium antitrust lawsuit will go to trial on March 3, 2014.

The case affects everyone nationwide who purchased Nexium as a consumer or a third-party payor. A separate Nexium class action settlement was reached in 2012 involving only Massachusetts consumers.

The class action lawsuit is about the price of Nexium and whether its manufacturer AstraZeneca delayed the availability of a cheaper generic version through anticompetitive agreements with potential generic Nexium manufacturers Ranbaxy, Teva and Dr. Reddy’s. The plaintiffs allege that the defendants entered into unlawful settlements of patent lawsuits. They claim these actions denied end-payors who paid for Nexium the benefits of competition and forced them to pay higher prices than they otherwise would have paid.

The defendants deny the allegations, asserting that the settlements of patent lawsuits did not violate antitrust laws and that their actions have not delayed the entry of generic Nexium products into the market.

The Nexium lawsuit was certified as a class action lawsuit on Nov. 14, 2013. Two classes have been certified: a consumer class and a third-party payor class.

    I always wondered why Prilosec went OTC and generic and Nexium never did? I’ve been taking Nexium since it first came out and I new something was up when Prilosec came and went and Nexuim was still a Name Brand drug, I have never been offered the generic of it or is it listed in my insurance formulary, Well it’s my turn now, they can reimburse me for the overcharges!!!!!!
