Tri-Cities Lifestyle Center Class Action Settlement

By Mike Holter

treadmillTennessee fitness club chain Tri-Cities Lifestyle Center has reached a class action lawsuit settlement with members for allegedly failing to honor reduced club-renewal fees included in their membership contracts. As part of the class action settlement, certain Tri-Cities Lifestyle club members can file a claim to receive $100 or a discounted membership renewal rate.

According to the Tri-Cities Lifestyle Center class action lawsuit, filed five years ago by two club members on behalf of members of the former Nautilus Fitness and Johnson City Health & Fitness Center, the company refused to allow club members to renew memberships at guaranteed reduced fees, thereby breaching contracts and unjustly and fraudulently enriching the defendants.

Under the Tri-Cities Lifestyle Center class action settlement, Class Members can file a claim to receive a one-time payment of $100 or membership renewals at a rate of $250 per individual or $336 per couple for as many annual renewals as they like as long as the renewals are submitted on time.

Class Members of the class action settlement include members of the former Nautilus Fitness and Johnson City Health & Fitness Center (now Tri-Cities Lifestyle Center) who purchased club memberships at guaranteed renewal rates of $75 per individual or $225 to $250 per couple that the company refused to honor after January 1, 2005.

To receive any settlement benefits, Class Members must submit a claim form by September 14, 2011. Claim forms and filing instructions can be found on the homepage of www.TriCitiesLifestyle.com under the “What’s New” heading.
