Union Bank Overdraft Fee Class Action Gets Green Light

By Kimberly Mirando

Union Bank
A U.S. District Judge in Florida has ruled that part of a class action lawsuit against Union Bank over allegedly excessive overdraft fees may proceed. The ruling, which affects hundreds of thousands of Union Bank customers, is part of a massive class action lawsuit accusing 30 of the nation’s largest banks of charging illegal overdraft fees.
Union Bank is just one of dozens of banks being sued by customers for manipulating the order of debit card transactions in order to maximize the overdraft fees they could charge on overdrawn accounts. JPMorgan Chase, Wells Fargo, U.S. Bank and Citibank are among the remaining defendants in the bank overdraft fee class action litigation, titled In Re: Checking Account Overdraft Litigation, which in 2009 consolidated lawsuits filed across the country.
Bank of America settled its part in the case earlier this year, without admitting liability, by agreeing to pay $410 million to refund customers. Under the Bank of America overdraft settlement, BofA customers will receive cash refunds or account credit for any overdraft fees that were paid relating to Bank of America’s unlawful practices. (You can find details on how to file a claim for the BofA Overdraft Settlement here.)
The bank overdraft fee class action lawsuit is In re: Checking Account Overdraft Litigation, U.S. District Court, Southern District of Florida, No. 09-md-02036.

I also noticed when checking my acct online that recent purchases would remain “pending” for up to 3 or 4 days before actually “hitting the books” and being deducted from my account until I made a purchase that would cause a small overdraft. That purchase amt would “hit the books” immediately, causing an overdraft and incurring fees for that and all subsequent amts that would have normally remained “pending”. Pretty shady, UB.

There was a time when I was becoming so frustrated with Union Bank of California. Every time I turned around I was being charged an over draft fee. Then I realized for some reason they would give me $200.00 extra when I would use my debit card. That didn’t stop anything. Then it was the day and time or just the day if it was on a Friday. Then there was a time they extended the hours till seven. It didn’t matter if you made a deposit after five it still would not be posted till the next day. What a mess!

Guess what a new bank sent me a coupon for one hundred dollars if I opened a checking account. I had nothing to lose. I did and I have been with them for four years and I have had no trouble or overdrafts at all.
