A federal class action lawsuit claims ConAgra Foods deceptively markets its Wesson brand vegetable oils as “100% natural,” even though they are made from genetically modified plants and/or organisms.
ConAgra sells four types of widely used cooking and food preparation oils under the Wesson brand; all Wesson oils are sold with a label on the front of the bottle that prominently states “100% Natural,” which is also used on all Wesson Oils online and print advertisements. According to the Wesson Oils class action lawsuit, however, Wesson Oils are not “100% natural” because they are made from genetically modified plants or genetically modified organisms.
The Wesson Oil class action lawsuit is brought on behalf of anyone who purchased any of the following cooking oils sold under the Wesson brand name: Canola Oil, Vegetable Oil, Corn Oil and Best Blend, from June 27, 2007 through the present. It is seeking damages and restitution for Class Members for violating several California business and consumer laws and for Breach of Express Warranty.
The case is Robert Briseno, et al. v. ConAgra Foods, Inc., Case No. 11-cv-05379, United States District Court, Central District of California.
UPDATE: On Feb. 23, 2017, ConAgra seeks to pause a Wesson cooking oil class action lawsuit while the company petitions the U.S. Supreme Court for review.
