HSBC Call Center Worker Class Action Settlement

HSBC Card Services has reached a class action lawsuit settlement with its call center employees for allegedly failing to pay them straight and overtime wages for all the hours they worked.
The HSBC call center worker settlement resolves a class action lawsuit, entitled Pinela v. HSBC, that alleges HSBC failed to pay its telephone-dedicated workers at its Wood Dale, Illinois call center for all work they performed throughout the day. Examples of the alleged unpaid work include the time employees spent booting up and shutting down the computer system, logging ion and off of computer applications, checking e-mails and updates, and reviewing HSBC communications, policies and notices. Plaintiffs allege that HSBC’s failure to pay for all such work-related activities constitutes a violation of the Illinois Wage Payment and Collection Act and the Illinois Minimum Wage Law.
HSBC denies the allegations but has agreed to end litigation by creating a $1,021,578.95 settlement fund to pay Class Members who submit timely claim forms. Class Members of the HSBC Card Services settlement are all individuals who were employed by HSBC as hourly paid telephone-dedicated call center employees in Wood Dale, Illinois at any time between August 17, 2002 and October 31, 2010. 
The amount of money Class Members can receive from the HSBC class action settlement will depend on a variety of factors, including: (1) the number of weeks that you worked at the Wood Dale Call Center during three time periods from August 17, 2002 up to October 31, 2010; (2) an average hourly rate for the three time periods; (3) a certain amount of time per work week for each of the three periods (shown below); and (4) a reduction of total weeks worked due to leaves of absence and holiday, vacation and/or time off under the TOP program.
A detailed breakdown of how payments will be calculated can be found in the Pinela v. HSBC Class Action Settlement Notice. In order to receive a payment, Class Members must filed a valid claim form postmarked no later than August 2, 2011

    I am a single mom and credit card consolidated my hsbc card. At the beginning of the year I contacted hsbc when I found out I had been paying for credit card protection on my act. they would not explain why I was other than I must have sign up for it. I keep asking why I would pay protection for a card that was closed. Then today I called cccs to see if they could help me figure out why my balance with them was still so high and my highest credit card was almost paid off. She placed me on hold and came back telling me that I needed to contact them because she see’s that since 09 through 2011 every yr. in apirl my act with hsbc had added 130-150 dollars on my acct. So I called them and explain what was going on and the lady placed me on hold a long time and came back on the line telling me to call a different number, I asked her why I would call another company and she didn’t say she said that that’s who would be handling my acct. Then I called and found out about this. I am really up set about it!! Please contact…..Mandy
