Lucky BrandThe Settlement Administrator for the Lucky Brand text class action settlement has confirmed with Top Class Actions that payments were mailed to qualified Class Members on Dec. 31, 2013. Several readers are reporting that they’ve received checks for $100, the maximum amount allowed under the deal.

The payments are part of a class action settlement reached between Lucky Brand Inc. and consumers in late 2012, resolving allegations that Lucky Brand and several marketing subcontractors violated the federal Telephone Consumer Protection Act by sending thousands of unsolicited text messages to consumers advertising a “Back to School” promotion. The TCPA prohibits companies from contacting people on their cell phones by using an automated dialing machine or by using an artificial or prerecorded voice without their prior express consent.

Lucky and the co-defendants denied any wrongdoing but agreed to establish a $9.9 million class action settlement fund to resolve the litigation. Consumers who received an unsolicited Lucky text message between Aug. 24, 2008 and Sept. 15, 2008 had until April 19, 2013 to submit a claim to receive up to $100 cash from the class action settlement.
