AmeriGasAmeriGas Propane and Columbia Propane Corporation have reached a class action lawsuit settlement regarding the installation, operation, maintenance and fueling of their propane installations in West Virginia. If you’ve ever owned a property in West Virginia that received propane services from AmeriGas or Columbia between 1994 and 2005, you may be able to receive up to $2,000 from the class action settlement.

AmeriGas and Columbia Propane have agreed to pay nearly $21 million to settle a class action lawsuit, titled Swiger, et al. v. AmeriGas Propane, Inc., et al., that alleges the companies failed to properly inspect and install the underground lines of propane systems of its customers and failed to protect the risers or seal the conduit.

You’re considered a class member of the AmeriGas settlement if you were a customer of either AmeriGas or Columbia Propane between October 18, 1994 up to and including December 31, 2005, and either:

(1) Had a propane system with an underground line or a line that was supposed to be underground on your West Virginia property during that time period that was owned, used, operated, installed, fueled, serviced or maintained, by either AmeriGas or Columbia, or

(2) You had an upright propane cylinder without an underground line but that cylinder was either moved or converted to an underground line during 2000 through 2005 as a result of a physical inspection.

An estimated 10,000 West Virginia property owners are included in the AmeriGas class action lawsuit settlement. The final amount to be paid to class members will be determined after the claim filing period ends and the total number of valid claims are evaluated, but you could receive a payment of $200, $250, $1,000 or $2,000.

To remain a member of the AmeriGas settlement class, you must file a claim form postmarked on or before June 30, 2011. This is the same deadline to exclude yourself.

The case is Samuel J. Swiger, et al, vs. AmeriGas Propane, Inc., AmeriGas Propane, L.P., James Walters, NiSource, Inc., Columbia Energy Group, and Columbia Propane Corporation, Civil Action No. 98-C-298.

That letter authorizes amerigas to make repairs to a system, that they didn’t install correctly in the first place, what kind of a screw job is this

  5. Anonymous says:

The letter essentially says, it’s $2000 minus the cost to bring the system with building code. And it goes on to say that if the cost is $600, you will receive the balance, which is $1400.
What if the repairs cost $2400, who pays the extra $400. So we were victimized by amerigas and now were being victimized again.
