cashmere-bouquet-body-powder-10oz-1_2A Massachusetts couple recently filed an asbestos lung cancer lawsuit against Colgate-Palmolive Company.

Plaintiffs Karen and David S. allege in their asbestos lung cancer lawsuit that Karen was exposed to asbestos through the defendants’ product, Cashmere Bouquet Body Talc.

Karen used the product between from the mid-1970s to 1990 and has allegedly developed mesothelioma and other asbestos-related diseases as a result.

While using the product, Karen claims she unknowingly exposed herself to asbestos by inhalation or ingestion of asbestos dust, fibers, and particles from the talc product. She further claims that Colgate-Palmolive’s product, because of its asbestos content, was defective when they sold it to her, and was therefore unreasonably dangerous, ultimately causing her to be diagnosed with a common asbestos cancer, mesothelioma.

According to the asbestos cancer lawsuit, had Colgate-Palmolive tested and inspected their talc products in the responsible and reasonable manner, Karen would not have been exposed to asbestos. The plaintiffs argue that it was Colgate-Palmolive’s duty to exercise reasonable and due care in all aspects of the manufacture, testing, and marketing of their asbestos-containing products.

The plaintiffs further allege that it was the defendants’ duty to adequately and effectively warn future and prior consumers and purchasers of the potential dangers and defects of their asbestos-containing products.

Additionally, Karen and David claim that the defendants expressly and implicitly warranted that their asbestos-containing products were safe for use in all their marketing and labeling, and Karen relied on this information for her own safety. She alleges that, due to her asbestos cancer, this product was not safe, and so the company breached their express and implied warranty.

The asbestos cancer lawsuit also claims that the defendants failed to perform their duty to consumers on a number of counts. The plaintiffs have filed on multiple counts, citing negligence; breach of expressed and implied warranty; malicious, willful, wanton and reckless conduct or gross negligence, and loss of consortium.

As a result of this asbestos exposure and subsequent asbestos cancer, Karen has allegedly suffered mental and physical pain, substantial medical expenses, a dramatic life expectancy reduction, and lessened enjoyment of life.

The plaintiffs are suing Colgate-Palmolive for the manufacturing, selling, and/or supplying of the talc product she used. Karen and David S. are also suing Cyprus Amax Minerals Company for supplying asbestos-containing talc to Colgate-Palmolive.

Asbestos Exposure Lawsuits
