testosterone-product-lawsuitA new Testosterone replacement therapy lawsuit was filed in  Illinois federal court against Eli Lilly and various other testosterone manufacturing companies.

The lawsuit is one of many lawsuits in the multidistrict litigation before Judge Matthew Kennelly. The testosterone lawsuit alleges that Eli Lily manufactured and marketed a defective and dangerous product and failed to warn about dangerous side effects associated with using the medication.

The testosterone lawsuit was brought by plaintiff Richard K., a resident of Will County, Illinois. Richard began using testosterone replacement therapy after being prescribed the medication at the end of October 2011.

Richard stopped using the medication in January 2014. The testosterone lawsuit alleges that during that time period he was prescribed the testosterone replacement therapy products AndroGel and Axiron.

While using these testosterone medications Richard allegedly suffered from a thromboembolic event. A thromboembolic event occurs when a clot that has formed in a blood vessel breaks loose and is carried away by the blood stream until it plugs another vessel.

The lawsuit accuses Eli Lilly of design defect, strict products liability, negligence, breach of warranty, fraud, and unjust enrichment. Richard is also seeking compensatory and punitive damages.

Overview of Testosterone Lawsuits

Testosterone replacement therapy, also known as androgen replacement therapy, is a booming business. Over the last decade the number of men being treated for low testosterone has more than tripled.

U.S. doctors write over 5.3 million prescriptions for Low-T, or testosterone replacement therapy treatments, each year. But numerous studies suggest that many of the men using low-T treatments are doing so unnecessarily.

A multidistrict litigation panel has begun for testosterone replacement therapy lawsuits in the Federal Court in the Northern District of Illinois. Generally, multidistrict litigation panels are begun when multiple individual lawsuits have been filed against one or more companies and the lawsuits share similar facts and questions of law.

The multidistrict litigation places all the cases before a single judge while pretrial motions and discovery is performed. This creates consistent pretrial rulings and efficiency for all the testosterone lawsuits involved.

Once the pretrial motions and discovery are complete many of the lawsuits will return to the jurisdiction that they would have been filed in originally had the multidistrict litigation not been convened.

The Testosterone lawsuit is Case No. 1:15-cv-06913, filed in the United States District Court in the Northern District of Illinois.
